Welcome to the latest issue of The NJSBA Docket, a monthly bulletin with news from the legal community and Association highlights.

News and Notices from the Courts


  • Based on the responses to the state Supreme Court’s survey on artificial intelligence, the Judiciary will conduct a series of virtual continuing legal education courses on AI and generative AI that will be available to attorneys at no cost.
  • On or after July 1, the Court will expand its attorney-conducted voir dire pilot program to criminal cases in Atlantic, Burlington, Cape May, and Hudson Counties.
  • The Court denied a Multicounty Litigation application for state cases against Monsanto Company, Bayer AG, Bayer Cropscience LP, Bayer Cropscience LLC, Bayer Corporation, and Bayer U.S. LLC, alleging injuries as a result of exposure to Roundup? Products.
  • The Court requests public comment on proposed amendments to Rule 3:26-2. The amendments would establish a process to review a defendant’s compliance with pretrial release conditions and clarify the timeframe and process for handling violations of monitoring.


Supreme and Appellate Decisions

  • Alejandra Padilla v. Young Il An—Whether owners of vacant commercial lots have a common law duty to maintain the public sidewalks abutting those lots in reasonably good condition.
  • Patrick Boyle v. Carol Huff—Concerning the indemnification clause in a condominium association’s bylaws and whether it applies to an indemnitee’s first-party claim for attorneys’ fees and costs against the association.
  • State of New Jersey vs. Taviaus Wilson—The panel reversed an interlocutory Law Division order suppressing handguns and a large-capacity ammunition magazine police found in a locked glove box during a traffic stop.
  • State of New Jersey vs. Jeffrey Walker—Denial of post-conviction relief petition to renegotiate individual restitution settlements for misappropriating health care insurance premiums.
  • State of New Jersey vs. Sean Jones—Whether the Court’s holding on juvenile defendants in State v. Comer should extend to offenders between the ages of 18 and 20 when they committed their offenses.
  • State of New Jersey vs. M.F.L.—A defendant sex offender’s motion to modify his conviction and sex offender restraining order issued pursuant to Nicole’s Law.
