Cosmetic Regulation Update - CMR substances added, Omnibus Act VII

The European Commission notified the World Trade Organization (WTO) of a draft of Regulation (EC) No 1223/2009 (cosmetic products Regulation), prohibiting the use of certain CMR substances in cosmetic products.

The draft published will amend the Cosmetic Regulation to introduce the Omnibus Act VII (Commission Regulation (EU) No 2024/197), introducing the newly classified CMR substances.

Omnibus Act VII will apply from the 1st of September 2025 and there will be no differences between placing it on the market and making it available on the market. It means that from the application date, non-compliant cosmetics cannot be sold in the EU.

21 substances will be added to Annex II, the list of banned substances for use in cosmetic products, not allowing its use from the 1st of September 2025 onwards, entry 1580 of Annex II will be replaced to include new information, and finally, in Annex III, entry 311 is deleted, as Trimethylbenzoyl Diphenylphosphine Oxide use will not be allowed.

Omnibus Act VII and Commission Regulation (EU) No 2024/197 will apply as of the same date with no exceptions. Even if this is a draft text, action is required!

As a cosmetic brand, please check whether your products contain the abovementioned ingredients. If so, you must proceed with a reformulation and all the necessary steps to ensure compliance of your products on the EU market.

SCCS Opinions, did you know what’s going on?

The SCCS, or the Scientific Committee on Consumer Safety, is a committee of experts that advises the European Union on the health and safety risks of non-food consumer products and services. The SCCS provides expert advice on the testing and safety evaluation of cosmetic ingredients. It also offers a platform for preliminary opinions open for comments.

The SCCS provides opinions on the health and safety risks of non-food consumer products such as cosmetic products and their ingredients. These opinions are used to inform and guide EU regulations, and the European Commission has the authority to amend regulations regarding the use of certain substances in cosmetic products based on the SCCS's safety assessments.

Therefore, the SCCS plays a crucial role in ensuring consumer safety by providing scientific advice that forms the basis for legal restrictions on the use of certain ingredients in consumer products.

Therefore, it's always a good idea to stay updated with the latest SCCS opinions and EU regulations.


MoCRA Update in June 2024: Allergen Labelling.

The FDA will propose rulemaking for allergen labelling under the Modernization of Cosmetics Regulation Act (MoCRA). The focus will be on the disclosure of fragrance allergens.

The next step will be the FDA listing specific fragrance allergens for disclosure in cosmetic products and they will propose rulemaking to follow, with a final rule due no later than 180 days after the public comment period closes. The expected date was June 2024, but at this moment nothing was published.

Nowadays, the rule is to label the same allergens of the EU Cosmetics Regulation, but this was published before the big update in Europe, the one going from 26 to 81 allergens to declare.

These changes are crucial for ensuring compliance and consumer safety. We'll inform you as soon as we have more information.

GREEN AND SUSTAINABILITY CORNER

New and upcoming legislation towards EU’s green transition

As more and more EU rules on sustainability labels and environmental claims are being updated/adopted, many existing environmental labels will likely fall short of compliance, furthering the reliability of the EU Ecolabel.

EU Ecolabel is a widely recognised third-party certification of environmental excellence. It is a voluntary environmental label for consumer products which meet specific criteria related to a reduction in the overall environmental impact, governed by Regulation (EC) No. 66/2010.

The proposed EU Green Claims Directive will complement the EU Ecolabel and is likely to stop companies from making misleading claims about the environment and the effects of their products and services in nature.

The new Regulation, named Ecodesign for Sustainable Products is expected to enter into force soon and aims to make consumer products more sustainable, repairable and circular.
