Introducing our enforcement session

Friday April 4th // Enforcement topic: Evidence and common sense are needed to determine where the truth lies?

In this session, attendees will gain insight into the evidence required to support legal claims across different jurisdictions, particularly in relation to patent infringement and validity. This will include comparisons between systems such as Germany, where courts rely heavily on written arguments and rarely require expert evidence, and the USA, where expert testimony is critical in almost all trial allegations. Understanding these differences is crucial, as evidence procurement can significantly impact the cost and strategy of IP proceedings.

Joining Julian Crump are our panellists:

????Judge Mr. Young Gi Kim (High Court Judge, IP High Court) (KR) ????Mr. Claus Becker (Partner, Glawe Delfs Moll) (DE) ????Mr. Dominic Adair (Partner, Bristows) (UK) ????Mr. Dong Suk Bae (Intellectual Discovery, Head of IP Biz Division, IP Transaction Project Leader, LG Electronics) (KR) ????Mr. Raja Saliba (Partner, Sughrue Mion) (US)

Key takeaways:

  • This session will equip attendees with a clearer understanding of what to anticipate if their clients face or anticipate patent litigation in Europe, the USA, or Korea.
  • In many jurisdictions, mere allegations (for example, about the skilled person and their knowledge) are insufficient.
  • Success often hinges on carefully framing the skilled person, their general knowledge, and their skillset to support a case.

Expert sessions

Expert speakers from Korea and across the world will share their knowledge across in three exciting strands: technical practice, practice management, and enforcement.

Senior IP attorney speakers will be joined by in-house specialists from businesses such as LG Electronics and Hanmi Pharmaceutical.

Topics include:

  • Anticipating and addressing rejections of claims to AI inventions in different jurisdictions
  • Same subject matter - A common denominator in trade mark and design?
  • Which IP firm should you hire? – A discussion from different perspectives?
  • AI assisted drafting and other AI assisted practices; how far have we come and how far can we go??
  • What evidence is needed in IP litigation in UPC, US, Germany, Korea and the UK to support a party’s legal?position?
  • IP service providers: Blessing or curse??
  • Availability of a letter of consent and potential risk for concurrent use of a similar trade mark under a co-existence agreement?
