The I.R.S. Notices Are Going Out
We have seen I.R.S. notices regarding failure to comply with ACA reporting requirements as far back as last year, but they are now starting to go out with much greater regularity. The attached notice was sent to a referral source of ours - interesting, they had clients of their own that they sent to Cimplx for ACA compliance and reporting, but the company itself, for reasons best known only to them, was not interested in using our (or any vendor's) services and never filed itself. Oops.
You will note that the notice is dated May 26, 2017 but it references tax year 2015. This is not unusual - most of the initial notices are going to involve filing from 2 years ago. If you haven't filed (for 2015 or 2016) you are playing with fire. If you did file, you'd better be sure you have your documentation in order, in the event that the I.R.S. has questions. Those of you who were depending on Congress to bail you out may have noticed that Congress can't get out of its own way. All that optimistic talk about repeal and replace will not provide much solace (and won't work as an excuse) should the I.R.S. come calling.
