Very proud to be part of the Faculty for the Hong Kong Investor-State Mediation Course. This is the third of these courses provided by ICSID, this time in conjunction with the Department of Justice and AAIL. It initiative demonstrates the important role that mediation is taking on, as one of the tools employed to assist in resolving Investor-State disputes. It is an important step for ISDS and will assist in deflecting the attack on arbitration, given that parties do now have the option to attempt mediation. There are still many obstacles to States mediating disputes, but due to the efforts of ICSID, ECT, CEDR and IMI, education, training and model protocols for States are changing the landscape and transforming obstacles into opportunities.
