Deciding to Move Forward with Your Idea

Name Your Invention & Make It Real

Now it’s time to make your invention real by giving your invention a name. It makes it easier to talk about and to reference and it makes the process more exciting! When you take the time and effort to name it, you’re committing to it in an entirely new way. In many ways, your invention is your baby. It came from you and it deserves a name that fills you with pride.

If you encounter red tape hurdles and possible technical setbacks along the way, the excitement that’s fueled by that pride of ownership keeps you focused on your goal.

Transform your invention into a tangible reality by giving it a name. A strong name simplifies communication and enhances your commitment. Here are key steps to consider:

  • Give It a Name: Choose something memorable instead of a lengthy description.
  • Check Domain Availability: Use sites like GoDaddy to ensure your desired domain is free.
  • Explore Alternatives: If the domain is taken, consider different extensions such as .net or .biz.
  • Verify Trademarks: Visit the U.S. Patent & Trademark Office to check for existing trademarks.
  • Consult an Attorney: A trademark attorney can help navigate potential conflicts.
  • Gather Feedback: Share your top names with trusted peers and consider using an NDA for protection.
  • Register Your Domain: Secure your chosen domain through a reputable registrar.
  • File for a Trademark: Consider an “intent to use” filing to transition from ? to ? once your product is in commerce.

Does Your Invention Exist or Are There Similar Products?

Let’s take your idea to the next level and begin searching for your invention.

Our goal is to gather as much information as possible and determine if your product already exists? Is there a similar product, but your idea is substantially different? Is your idea just like many others in the market? What should you be looking for when searching for your idea?

As you explore the viability of your invention, it’s crucial to determine if similar products already exist. This involves thorough research to gather information and assess the uniqueness of your idea. Here are some steps to guide you through this process:

  • Identify Similar Products: Look for products that closely resemble your invention or solve the same problem.
  • Evaluate Scenarios: Unique Idea: If your invention is entirely new, congratulations! Investigate why it might not be on the market, considering demand or practicality. Substantially Different: If you find a similar product, compare and highlight how your idea is distinct. This could indicate a need for a better solution. Similar to Existing Products: If your idea resembles others, don’t lose hope! The market’s interest suggests potential. Just ensure you’re not infringing on existing intellectual property. Duplicate Idea: If you discover a product that is exactly like yours, it may be time to shift focus. Consider purchasing the product to learn from it, and remember that new opportunities always exist in a vast market.

Approach your research with an open mind and objective perspective, and remember that the journey to innovation is ongoing!

What Can Be Licensed?

What can be licensed? Almost anything can be licensed as long as it contains a protectable property right. These intellectual property rights can be legally protected through patents, trademarks, copyrights, know-how, and trade secrets. Licensing allows someone to use another’s protected legal IP rights under the terms set in a license agreement.

There are various types of licensable IP rights. “Technology” is a commonly licensed category, which includes useful products, materials, machines, processes, or methods with practical or industrial applications, such as pharmaceuticals. Once the legal requirements are met, a new technology can be protected by a government-issued patent and then licensed to a licensee by the patent holder. Technology in the form of trade secrets or know-how can also be licensed.

New expressions of ideas, like literary and artistic works (books, paintings, films, musical compositions), are protected by copyrights. Copyrightable expressions also include practical objects such as software, product labels, and architectural designs. Use of these works—such as copying, performing, or distributing—requires permission from the copyright holder.

Trademark rights can be established through the use of names, logos, symbols, or other identifying characteristics that connect a mark with a product or service source. These rights, associated with goodwill, can also be licensed to others.

Modernizing Our Systems: TTAB Center Open Beta Launch

As part of our ongoing efforts to modernize our systems and enhance the customer experience, we’ve launched the open beta of the Trademark Trial and Appeal Board (TTAB) Center for filing notices of opposition. An opposition is a TTAB proceeding where a party can challenge the registration of a trademark.

During the six-month open beta period, customers can file notices of opposition using either TTAB Center or the existing platform, the Electronic System for Trademark Trials and Appeals (ESTTA). Users are encouraged to provide feedback on their experience via a blue “feedback” button on the TTAB Center webpage. This feedback will help us refine the system before its official launch in spring 2025.

Over the coming years, TTAB Center will become the central platform for all business conducted with the TTAB, replacing ESTTA. This new system offers enhanced security, improved options for saving and sharing draft filings, and a centralized docket to view all pending and completed filings.

Invention History: Dorr E. Felt and the Comptometer

Dorr E. Felt, the inventor who revolutionized business calculations

On October 11, 1887, Dorr E. Felt was granted a patent for the Comptometer, an early mechanical adding machine. His journey began with experiments using a simple "macaroni box" to house the components of the device. The Comptometer became the first successful commercial adder, simplifying calculations for businesses.

The device used nines-complement arithmetic for subtraction and repeated addition for multiplication, offering a single register of results. Its practicality led to widespread adoption, and soon, "Comptometer schools" were established to train operators on the machine's efficient use.

The Comptometer's success not only streamlined business operations but also paved the way for advancements in mechanical calculators and early computing technology.
