Information In 2018
Do you remember when you were 18 years old? Where were you, mentally speaking? Did you think irrationally, or where you born with an “old soul”? I like to think I made good decisions all the time, but you and I both know that is not the case- of course not. What we now call wisdom, really boils down to having enough information to make an informed decision. You see when we were 18, our ability to apply rational and logic to everyday scenarios was compromised for the most obvious reason, lack of quality Information! What if I told you, your path would have been easier if you knew what you know now. Lol- we have all said that.
Let’s jump ahead 18 years and now we are in the new age of INFORMATION or DATA. You got it, the key to our bad decisions back then starts and ends with information. I know you’re like, what the heck is he talking about? I really can only speak for myself, this is not legal advice, just speaking from my own set of experiences in the last 18 years.
So, now that we know that information is the key to making better decisions. How do we apply that to our work lives and how does that impact our trajectory in business, or what we really mean, how does information impact the bottom line?
“ The Access To Information And Protection Of It, Has Become The Gold Of The New Future."
-Carl Dunn
The access to information and protection of it has become the gold of the new future. What I mean by the new future is, your ability to protect your asset. Your asset is your information.
Whether you understand that plight or not, you must assuredly know we are all vulnerable to the imminent threats of our personal information being compromised daily. It is not any less stressful knowing our lives are on a cloud somewhere waiting to be precipitated like a particulate of rain. Having this information at our fingertips has proven to outweigh potential dangers, thus far. It's just too dang convenient, and advancing exponentially.
I hope you understand where I am coming from. If given the opportunity to learn a little more about an idea, place, person, or thing; businesses will exercise due diligence. The due diligence or information gathering process will assist in making an informed business decision, that can have an impact on the bottom line.
Why? Well, businesses must try to protect all liabilities. What is a liability for a business you ask? Great question! A liability can be an idea, a thing, a place, or a person that may negatively impact a business from sustainability and growth. Negligent hiring can also impact a business as well. Best advice is to always have insurance that covers your insurance-insurance, no pun intended.
If a business acts in the best business interest and possess a legitimate and permissible business reason to request vital information about people, places, ideas or things; then that business is acting in good faith and by law can request private and public information that is directly associated with that business reason for the purposes of fulfilling authorized and permissible 3rd party business requests.
At ACUTRAQ we can provide businesses and property managers tools to successfully implement our background screening services. During the applicant cycle it is imperative for a company in today’s time to know more information; for the purposes of executing business with integrity, stewardship of commerce, and a business right to protect itself from potential liabilites. ACUTRAQ can help with that protection, with 20+ years of experience, we have specific knowledge that can make the process of screening your prospective applicants seamless.
Below you will find the FCRA and other Acts from the constitution, that were created to protect consumers and give consumer reporting agencies (CRA’S) guidelines to follow.
The Fair Credit Reporting Act, 15 U.S.C. § 1681 (“FCRA”) is U.S. Federal Government legislation enacted to promote the accuracy, fairness, and privacy of consumer information contained in the files of consumer reporting agencies. It was intended to protect consumers from the willful and/or negligent inclusion of inaccurate information in their credit reports.
To that end, the FCRA regulates the collection, dissemination, and use of consumer information, including consumer credit information.[1] Together with the Fair Debt Collection Practices Act ("FDCPA"), the FCRA forms the foundation of consumer rights law in the United States. It was originally passed in 1970,[2] and is enforced by the US Federal Trade Commission, the Consumer Financial Protection Bureau and private litigants.
The Consumer Financial Protection Bureau (CFPB) is an agency of the United States government responsible for consumer protection in the financial sector. CFPB's jurisdiction includes banks, credit unions, securities firms, payday lenders, mortgage-servicing operations, foreclosure relief services, debt collectors and other financial companies operating in the United States. The CFPB's creation was authorized by the Dodd–Frank Wall Street Reform and Consumer Protection Act, whose passage in 2010 was a legislative response to the financial crisis of 2007–08 and the subsequent Great Recession.[2] The CFPB's status as an independent agency is currently questioned due to a circuit split in the U.S. Court of Appeals and a New York Federal District Court
