IMPORTANT EB-5 INVESTOR ALERT!

An important clarification has been issued on 11th October 2023, about how the U.S. Citizenship and Immigration Services (USCIS) calculates the sustainment period for EB-5 petitions?

If you are a new investor in the EB-5 visa program, that is, if you’ve filed your Form I-526 either on or after 15 March 2022 (after the new regulation as per the Reform and Integrity Act (RIA) came into effect), the requirement to maintain investment (min. $800,000) throughout your conditional residence has been removed.??

This means, you no longer need to sustain your investment throughout your conditional green card period, which may prolong for years as it is dependent on factors such as visa availability. It also means, you would be eligible to get your capital repaid as early as 2 years from the date the investment was contributed to the New Commercial Enterprise (NCE) and placed at risk in accordance with applicable requirements, including being made available to the job-creating entity and the required jobs being created.??

However, we recommend that you still be prepared for your investment to be locked in for a period of 3-5 years, for all practical reasons; which is still better than the earlier 5-7 years waiting period.?
