?? ICE Ends Flexibilities for International Students on F & M Visas

Big changes are underway for international students next year. Currently enrolled F and M students are permitted to complete the 2022-2023 academic year under the flexibilities for remote or online learning, which will remain in effect until the conclusion of the summer semester in 2023. However, for the 2023-2024 academic year, these?students will no longer be allowed to count online classes towards meeting the full course of study requirement . This regulatory limit stipulates that F students may take no more than one class or three credits per term online, while M students are not permitted any online instruction.

Programs for new or re-entering students must comply with the regulatory limits on distance learning. In light of this announcement, Designated School Officials (DSOs) are advised not to issue I-20 forms for new or initial students who are located outside the United States and intend to take classes at a certified institution with online components that exceed the regulatory limits. Consequently, international students are no longer able to maintain Active status as an F-1 or M-1 nonimmigrant while taking online classes from outside the United States. Students who wish to continue their studies in F-1 or M-1 status must re-enter the United States in order to attend school.

?? Remote Work Flexibilities Ending: Employers Must Resume In-person Form I-9 Verification

Attention employers and new visa hires! Employers will be given a period of 30 days to achieve compliance after the COVID-19?I-9 flexibilities ?come to an end on July 31, 2023. Form I-9 processing entails the completion of the form on the first day of hire by the employer. Within 3 business days, the employee is obligated to provide original documentation in person to verify their identity and work authorization.

In response to the expansion of remote work during the COVID-19 pandemic, DHS and ICE suspended the physical inspection of identity and employment eligibility documents for Forms I-9 in March 2020. It was expected that the physical inspection would take place within three business days once regular post-COVID operations resumed.

In October 2022, DHS and ICE announced an extension of these flexibilities until July 31, 2023. The latest announcement now specifies that?employers have until August 30, 2023, to conduct all the necessary physical examinations of identity and employment eligibility documents for individuals hired on or after March 20, 2020. This applies specifically to those individuals whose Form I-9 identity and eligibility documents were verified through a virtual or remote examination.
