Immigration and DWIs

Immigration and criminal law (aka “Crimmigration”) often mix. Nowadays, this is especially true. 

Most recently, an immigration ruling from Attorney General William Barr noted that a noncitizen with 2 or more DWIs, despite any rehabilitation efforts (treatment, AA, ect.), is presumed to lack “good moral character.” Attorney General William Barr's opinion can be read here: https://www.justice.gov/eoir/page/file/1213196/download

What does this mean? A lack of “good moral character” for a noncitizen can: 

1. Prevent them from becoming a citizen;
2. Prevent them from returning to this country; 
3. Make them deportable; and 
4. Prevent them from getting all sorts of immigration relief from deportation (Cancellation of Removal, Violence Against Women Act, ect.).
