Beyond Cura?ao: Exploring Alternative Jurisdictions for Online Gaming Operators

The European online gambling market is expected to experience significant growth, but Cura?ao's regulatory changes and legal challenges have made it a less attractive option for operators.

Operators who have traditionally opted for a Cura?ao license are now facing a more rigorous licensing and monitoring process. Some Cura?ao-licensed operators have faced lawsuits in European countries, with some being ordered to refund losses to players. The Cura?ao court has upheld these judgments, declaring the operators bankrupt.

However, Malta has taken a different approach, protecting its licensees from foreign court interference. Alternative jurisdictions such as Kahnawake, Anjouan, and Tobique are emerging as appealing options for operators. These jurisdictions offer protection against opportunistic lawsuits, flexible management, and stability and predictability.

Kahnawake is known for its stringent regulatory framework and legal resistance to litigation, while Anjouan and Tobique offer favorable conditions for online gambling operators, including the absence of a physical presence requirement. Operators looking for alternative jurisdictions should consider these factors when choosing a new licensing base.
