As well as all of our usual resources including the Contentious Clinic, webinars with others in the sector and brand new content, not to forget our upcoming online Claim Checkers, we have got lots of treats in store for our IDRN members in October.? Did you catch Martin Holdsworth's Contentious Clinic in September? It covered off everything you need to know if you receive the dreaded Larke vs Nugus request.
This issue?is clearly not going anywhere, as Martin asked the viewers?‘How many of you have not had a Larke and Nugus request in the last 12 months?’ – and with around only 25% answering ‘no’, this left a staggering 75% of attendees having had such requests and demonstrating an?increase. Not only did this illustrate the relevance of the topic??but it demonstrated just how necessary knowing how to correctly respond to a Larke Vs Nugus request actually is.

Will Validity Challenges?
Stay tuned for our next Contentious Clinic on?Tuesday 31st October, 12pm. We'll be joined by Solicitor, Georgina Coates who will lead the clinic for a detailed session on Will Validity Challenges, also joined by Richard Thomas, Partner? from IDR Law. They'll be covering off the different types of challenges and how to tackle them.

Laura has been part of our triage team?since she started back in 2020, so many of you?will have already?spoken to her if you have referred a case across to IDR.?As our Head of Partnerships Laura will now be managing our referrer relations and will be there to help as and when you refer a client across to us or just need some extra guidance.

Case Summary Highlight? ?
'The recent case of?Spencer v Estate of John Mitchell Spencer & Ors [2023] EWHC 2050 (Ch)?is a classic case of the Court exercising powers to uphold a promise made where the person to whom the promise was made has relied on the same to his or her detriment.
Proprietary Estoppel Claim
The claim was brought by Michael Spencer, son of John Spencer (the “Deceased”) and brother to Jane and Penny, defendants in the claim. In short, Michael claimed that the Deceased had made promises throughout his life that the farmland on which he and the Deceased worked together would be his. Michael’s evidence recalled the Deceased saying things like “… it will all be yours one day” and “You are going to inherit it so I don’t know what your problem is with the amount of money you are earning”.
