IBC, 2016 : Defects And Delay by STC

In a recent case of State Trading Corporation v Ganesh Benzoplast Ltd [2022] GCtR 235 (NCLATrib), State Trading Corporation ["STC"]'s Counsels have filed defective IA.

This defection application is filed for State Trading Corporation after they have filed the appeal with delay. Even earlier in 2021, the counsel for State Trading Corporation in his own way?sought "two weeks more time to comply the Order dated 16.09.2021 whereby the STC was directed to file I.A. for condonation of delay in filing the Appeal within two weeks." It was again noted that STC again failed to comply with "Order dated 06.10.2021" as "it appears that" Learned Counsel for STC was directed to file an I.A for ‘Condonation of Delay’ within two weeks from 6 Oct 2021.
