Human Rights Tribunal of Ontario Seeks Input on Important Process Changes

The Human Rights Tribunal of Ontario (HRTO) recently announced it is seeking feedback on important changes it suggests are designed to streamline its process.

The key proposed changes are as follows:

• Mandatory Mediation – Mandatory mediation will be scheduled for any application that falls within the HRTO’s jurisdiction. If a matter does not settle, it will then be scheduled for hearing.
• Amendments to Disclosure Deadlines – Disclosure dates for documents and witness lists will be tied to the date of the mediation, rather than the date of hearing.
• Removal of Case Management Conference Calls and Summary Hearings – While some employers have found these processes useful to address pre-hearing issues or applications that have no reasonable prospect of success, the HRTO is proposing their removal as they have not led to more “efficient resolution of applications.”
