As we already mentioned before, the EB-1A immigration visa is for people of extraordinary abilities and outstanding specialists in the arts, sciences, business, education, or athletics. In order to be able to apply for this visa you have to satisfy at least 3 out of 10 requirements. So what are the EB-1A criteria?
All immigration visas are pretty demanding when it comes to the criteria the applicant has to satisfy in order to get approved. The EB-1A visa is no exception for that matter. With EB-1A you have to either prove you’ve sustained international acclaim, meaning you’ve won awards or prizes for excellence on an international level and your achievements have been recognized in your field internationally. This is called a one-time achievement. In case you can present evidence of this kind, you already can get an EB-1A visa alongside a Green Card. But don’t panic if you don’t have one. In this case, you have to meet at least 3 out of the 10 criteria described below.
?? You have some other international or national achievements for excellence (of lower merit)
?? You are a member of an association in your professional field which demand outstanding achievements of their members
?? You can provide evidence of articles and published materials about you in professional or major publications or other major media
?? You were asked to judge the work of others in some kind of competition
?? You can provide evidence of your contribution of major significance to the field
?? You have written articles or conducted studies, that were published in major publications or media
?? You took part in an artistic exhibition or showcase
?? You can provide evidence of your leading or critical role in distinguished organizations
?? You have a higher salary compared to others in your field
?? You can provide evidence of your commercial success
Benefits of an EB-1A visa
?? You can work and live in the U.S. while your petition is pending
?? You can travel outside the U.S. while USCIS is reviewing your petition, something that other visas can’t offer
?? You can speed up the review process to 15 days for an additional cost
?? This visa doesn’t require an American employer
?? This immigration program doesn’t require investment on your part
?? Your Family, meaning your spouse and your children under 21, can move to the U.S. with you. They will also get a Green Card
How long does it take to get an EB-1A visa?
The process of preparing, filing the documents and putting your case together usually takes about 6 months. After we file your case, the USCIS (U.S. Citizenship and Immigration Services) generally reviews your case for another 6–8 months. However, you can speed up this process to 15 days for an additional cost.
