Artificial intelligence (AI) is rapidly transforming industries, from healthcare to finance and beyond. While its potential to revolutionize business operations is undeniable, leaders everywhere need to keep an eye on AI regulation when building out their current and future strategies with the technology.??
AI regulation is very much in the initial stages, and governments worldwide are loudly grappling with the need to balance innovation with societal concerns over privacy, data ownership, and more. As AI becomes more pervasive, these questions surrounding data, algorithmic bias, and job displacement will only intensify. As a leader, here are some things you should keep in mind.??
The Current Regulatory Landscape?
Governments around the world are taking steps to address the challenges posed by AI. While the regulatory landscape varies from country to country, several key themes are emerging:?
- Data privacy and security: Regulations such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) are imposing stricter requirements on how organizations collect, use, and protect personal data. AI systems that rely on large datasets must comply with these laws, which have already had a notable impact on how many companies do business.??
- Algorithmic bias: Governments are concerned about the potential for AI algorithms to perpetuate or amplify existing biases. Initiatives are under consideration to develop guidelines and standards for fairness and transparency in AI; leaders can get ahead of any potential regulation by analyzing how their own AI efforts are potentially promoting bias.??
- Job displacement: The automation of tasks through AI raises concerns about job loss and economic inequality. Governments are exploring policies to mitigate the negative impacts of AI on the workforce. Companies are already wrestling with how AI will impact their current staffing, and it’s worth considering that massive layoffs tied to AI could attract regulatory or media attention.??
- Autonomous systems: The development of autonomous vehicles, drones, and other self-driving systems presents unique regulatory challenges. Governments are working to establish frameworks for the safe and responsible deployment of these technologies. If your business deploys drones or works on self-driving systems, for instance, you may find yourself in the regulatory crosshairs at some point.?
- Artificial superintelligence: Governments are increasingly focused on the rise of extremely powerful AI models and how to potentially stop them if they turn dangerous (for example, California’s recently vetoed SB 1047, which I’ll cover in more detail in a bit). More national and state governments could introduce legislation mandating a “kill switch” or similar measure in larger models. It’s important to note, though, that governments will likely want a carve-out for the use of strong AI in military applications, such as autonomous targeting.?
Preparing for an Uncertain Regulatory Landscape?
California’s state government is a good example of a testbed for AI regulation. Its newly signed laws require robocalls to disclose whether they’re AI-generated; ask companies to insert identifying watermarks into the metadata of content created by AI; and crack down aggressively on AI deepfakes. Although California governor Gavin Newsom recently vetoed California SB 1047 (also known as the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act), which would have required tech companies to institute “safety plans” for their respective AI models (among other checks), similar bills will almost certainly appear in the future.??
The state of federal regulations is less clear and is likely to remain so until after the election. In the meantime, organizations must adopt a proactive approach to AI governance. Here are some key strategies for business leaders that want to stay on top of this:?
- Stay informed: Monitor regulatory developments at the national and international level. Subscribe to industry newsletters, attend conferences, and engage with policy experts; if your company has in-house attorneys or other legal experts, make sure they’re keeping an eye on the evolving AI conversation. - Conduct a regulatory impact assessment: Evaluate how existing and potential regulations may affect your AI initiatives. This will help you identify potential risks and develop mitigation strategies.?
- Start by identifying relevant laws and regulations: These might include data-centric laws such as GDPR; depending on your industry, you may need to take other regulatory frameworks into account, such as HIPAA.?
- Identify your own use cases: How will your organization specifically use AI, and how do those potentially overlap with the relevant laws and regulations??
- Develop mitigation strategies: Create a matrix that breaks down regulatory and legal requirements for your organization’s various AI use cases, and use that to identify any gaps in compliance. ? ?
- Build a strong compliance framework: Implement robust data privacy and security measures to protect sensitive information. Develop policies and procedures to ensure ethical and responsible AI use, and make sure that your organization conducts regular assessments to identify emerging risks and regulatory challenges. - Invest in talent: Hire or train employees with expertise in AI ethics, data privacy, and regulatory compliance. At
