How often do buildings need to be inspected in Florida?

Florida is a state that experiences a wide range of environmental conditions, including hurricanes, high humidity, and heavy rains. As such, it is imperative that buildings within the state are regularly inspected to ensure the safety of occupants and the structural integrity of the building.

A new state law in Florida now requires that all buildings, except for single-family homes, undergo a recertification inspection at least once every 30 years, or 25 years if within 3 mi of a coastline, with a follow up inspection & recertification every 10 years. It is currently required in Miami Dade and Broward counties and the deadline for compliance in the rest of the state is by 12/31/2034. This law is in place to prevent buildings from becoming unsafe due to age and wear and tear.

Building owners are responsible for hiring a certified inspector to conduct the inspection and prepare a report for the local building department. The jurisdiction in which the building is located will mail out a notice when it is time to have the building inspected but even if a notice is not received, the recertification must be completed as required.

The ramifications of not complying with the inspection requirements can be severe for building owners, managers, and HOA board members. Failure to comply with these laws can result in fines, penalties, and even the revocation of a building's certificate of occupancy and order for demolition. In addition, if an accident or injury occurs due to a building's failure to comply with inspection requirements, building owners, managers, and HOA board members can be held liable.
