The following interests will impact a purchaser’s use and enjoyment of their title - we have listed these from least impactful to most impactful:

  • Easement: An easement provides you with a right to use someone’s property for a certain purpose.
  • Covenant: A promise to do something or not do something.
  • Encumbrance: A mortgage that secures obligations and repayments (even a standard mortgage is technically an encumbrance).
  • Caveat: A caveat prevents you from registering any interests on your title (including a mortgage or transfer) and even prevents you from selling your home.
