Starting a nonprofit is a noble endeavor for anyone, often driven by the desire to make a difference in the world. However, it’s also a complex process fraught with legalities and regulations that can easily be overlooked. When I founded For My Bonus Child, Inc. in Miami, Florida, I thought I had done everything by the book. I had my legal paperwork, my 501(c)(3) designation, and a clear vision. But there was one crucial requirement I missed: filing the solicitation paperwork with the Florida Department of Agriculture and Consumer Services (FDACS). This oversight could have resulted in fines and even arrest.
Here’s how I narrowly avoided disaster, thanks to SCORE's invaluable support, and how you can ensure your nonprofit stays compliant with Florida’s regulations.
The Importance of Proper Filing
In Florida, any nonprofit that solicits donations from the public must register with the FDACS. This requirement is separate from obtaining federal 501(c)(3) status and is crucial for operating legally within the state. Failure to comply can result in significant penalties, including fines and criminal charges.
Here are the key steps to ensure your nonprofit is correctly filed in Florida:
My Journey with SCORE
Despite my thorough research, I missed the FDACS registration. This oversight came to light thanks to a SCORE mentor. SCORE is a network of volunteer, expert business mentors dedicated to helping small businesses get off the ground, grow, and achieve their goals. My mentor at SCORE not only pointed out this critical requirement but also guided me through the process of filing the necessary paperwork.
I cannot overstate the importance of having a mentor who is knowledgeable about local regulations. SCORE offers free, confidential business mentoring and training workshops to both existing and aspiring small business owners. Their mentors have been instrumental in the successful launch of For My Bonus Child, Inc., and I am incredibly grateful for their support.
