How to enhance institutional arbitration in Africa

Ahmed Ouerfelli was among the speakers in the conference held in Dar Essalaam, Tanzania, from 24 to 27 May 2022, Conference coorganized by GIZ and the Ministry of Justice of Tanzania on Arbitration in Africa.

In his paper, Ahmed Ouerfelli discussed the ways to enhance institutional arbitration in Africa. A special focus was made on the landscape in Tunisia. One of the issues addressed by the speaker was the relevance of enacting a law or regulation setting conditions for establishing arbitral institutions, in a way to ensure the seriousness of the promoters of arbitration centers. A long debate followed about the role to possibly be played by the state authorities in licencing or supervising those institutions.

Ahmed Ouerfelli mentioned in particular the key role to be played by think tanks and civil society organisations such as Afriqya Arbitration Forum, recently established in Tunisia.?
