Amii Barnard-Bahn, JD, PCC and I just had our article published in Society of Corporate Compliance and Ethics (SCCE) ’s Compliance & Ethics Professional (Feb. 2023), p. 32, “Retaliation: The Not-So Silent Killer of Compliance and Ethics.”??We make the point that it is never enough just to have a statement in your code of conduct that you don’t tolerate retaliation; it is wishful thinking to believe this can be effective. It takes strong management steps to prevent and address retaliation.??Among other points, we recommend that you treat retaliation as a serious compliance risk in your risk assessment just as you would any very likely and very dangerous risk.??We also recommend, borrowing from Roy Snell ’s book, "The Accidental Compliance Professional,” not waiting for people to call you to report concerns. Go out into the field and listen to your people.??Ask them what concerns they may have.??We also recommend ongoing outreach and monitoring of those who have had the courage to speak up; retaliation can be subtle and can occur long after the original whistleblower report.??
