HOW DO YOU CONFIRM A LAND THAT IS COMMITTED OR LAND THAT IS NOT FIT FOR PURCHASE ?(APRIL SERIES 4)

Some days ago one of my followers asked me a question about "How to know a land is not fit for Purchase?

The only way to know whether a land is not fit for purchase is to conduct a due diligence or Land search before you purchase the land.

The following will guide you through on how to do your Due Diligence:

  1. Ask for the survey plan of landed property from the seller,
  2. Seek for the service of surveyor to confirm the coordinate on the survey plan of the landed property
  3. Go further and seek for service of lawyer or surveyor to confirm all information's of the landed property in government organization like Land bureau or Ministry of physical planning and Urban Development if possible

All this process should be done before you pay your hard-earned money for property.

The following are the Land that are not fit for buying:

? *LAND THAT IS COMMITTED BY THE GOVERNMENT FOR PUBLIC USE:* Land that are under committed acquisition, that is government have committed it for a particular project or purpose, That shows such land have been committed to build schools, hospitals, Roads or Railway, If buy such land your money is as good as gone.

If you see Town Planner Officers or Government Agency mark Some buildings for Demolition that show the land is under Government Acquisition but encroached by Land Encroacher for there selfish Interest,This normally happen when people buy land without doing any Due Diligence.

So if you want to buy Land do your Due Diligence,Go to Land Registry to check the status of the land,the title of the land,the document,Chart the coordinates of the lands to confirm whether that the late is safe and free to invest in,Once you make payment for committed land, your money is as good as gone.


? *LAND BELONGING TO SOMEONE WHO IS NOT ALIVE AND IS CAUSING A DISPUTE IN THE FAMILY:*

Let us use this scenario as an example,you want to buy a property from an Individual or family, after you request for all the documents that you will use to do your Land search,you find out the owner of the property is not alive again,how do you ensure you will not get to into a trouble and after buying the land, the solution to this Scenario is to ask for the Will of the Deceased, you will ask for the *will* ,this will is going indicated that the property was willed to the person that want to sell it to you.


What happen if there is no will,there should be a *letter of administration* starting the administrator of the decreased estate or Property,if you go and buy such Property without the will or Letter of adminstration or without the knowledge of administrator or executor of the will of the deceased estate or Property and then you might have bought yourself a lawsuit,If you did not see any of the document,the best thing to do is to stay away from such land.


? *LAND THAT BELONGS TO DIFFERENT PARTY OTHER THAN THE PERSON THAT WANT TO SELL LAND TO YOU:*

Let talk about the land that belong to a different party other than to the person that want to sell it to you:One thing you must always ask for before buying a property is Survey Plan, Deed of Assignment, showing the name of the seller,Once the Deed of Assignment is not showing the name of the seller then stay away from such Property unless you are dashing out your money to a fraduster. This kind of incident happen in a community in Akure where one family sell the lands of another family to people which later leads to a dispute in the community but after some years the court gave order that the real owner of the landed Property to take control of the land which really caused a lot of damages for the people that have bought from the fake family.


My Advise for you as a Real Estate Consultant is that anytime you want to buy a piece of property Somewhere, make sure you do your Due Diligence before you pay the seller your hard earned money,Hope you understand.
