How to cite legislation?

We have had some clients asking about the correct way to cite legislation. So, we have decided that an article explaining this would help.

The issue has been that when our clients have gone to a notified body said notified body has requested that the legislation be cited in the same format as the standards. The main issue here is related to the amendments to the legislation. The notified body had requested the legislation be cited with the amendments the same way the standards do.

This is incorrect.

?The issue is the amendments for the legislation are incorporated into the base legislation when viewing them on www.legislation.gov.uk there will be a little textbox at the top of the page stating that the legislation is currently up to date or currently has outstanding changes. Therefore, whilst the amendments can be found as separate pieces of legislation there is no need to cite these as part of the impacted legislation. The legislation is referred to by the title it was published with, it is assumed that the legislation was checked by you before citing it.

The way to cite standards like this:?

EN 131-2:2010 +A2:2017

or?

EN 131-2:2010 +A2:2017 – Ladders – Part 2: Requirements, testing, marking.

The way to cite legislation is different from this. For England and Wales, the way we cite primary legislation is:

the Health and Safety at Work etc. Act 1974 (c. 4)?

or

1974 c.4 (where c is the chapter referenced).?

The way we cite secondary legislation is equally similar:?

the Provision and Use of Work Equipment Regulations 1998 (S.I. 2306)?

or?

S.I. 1998/2306?

or?

1998 No. 2306.

As you can see the citation for legislation is very different to that of the standards. This is a good thing, as this means you can quickly know where to look for the quoted item based on the formatting of the citation. The primary and secondary legislation are accessible through www.legislation.gov.uk (for the UK) or www.eur-lex.europa.eu (for the EU). The standards need to be accessed via BSI or ISO (or the like).
