MAXIMISING TECHNOLOGY IN LEGAL SERVICE DELIVERY

INTRODUCTION

Given the invaluableness of data and online transactions in our world today, there has been an inevitable demand for legal technology. Technology makes everything better. This is evident in every aspect of society and the legal industry should not be exempted lest legal service delivery becomes obsolete or anachronic . How do we embrace technology in promoting justice and fairness?

Clearly, the unprecedented COVID-19 pandemic has shown the world that virtual activities are even more accepted now than ever in solving business and operational challenges. During the pandemic, Nigeria and the world witnessed academic activities being carried out online, virtual court hearings and corporate bodies holding their meetings virtually.

Technology is no doubt having a significant impact on several industries and how professionals work. The legal profession is no exception. The advancement in technology has helped improve lawyers efficiency and enabled them to take on more task than previously possible. Virtual hearings, digital case management, online research bases, digital contracts and computer stimulations amongst others are some of the technological solutions transforming the legal industry and increasing productivity.

With the perpetual acceptance of technology into our daily lives and gradual phasing out of the conventional mode of conducting business and social activities, it has been made essential for the beaming of searchlights of the legal aspect of the technological adaptations. As the use of video and audio-conferencing tools increase significantly, corporate organisations have been ramping up their technology infrastructure to account for the surge.[1]

Legal technology essentially means the use of technology and software to provide, aid and support legal services.[2] Legal practice is a passion driven venture.[3] The legal practitioner requires a special form of professional artistry to effectively deliver his/her client’s goals and expectations. The role of technology is to aid in the delivery of these goals/expectations and not to replace the legal practitioner.

Furthermore, the role and benefits of technology in the legal profession is endless. Imagine a world where legal practitioners do not have to physically file pleadings in court. Imagine a digital repository which allows court clerks and registrars to capture and manage pleadings and notices filed.

Below are some of the ways in which technology can help in the delivery of legal services:

? The Use Of Artificial Intelligence

AI is an acronym for Artificial Intelligence which is the simulation of human intelligence processes by machines, especially computer systems. Studies has shown that an artificially intelligent research platform can complete research in seconds, and whether a law firm has 400 lawyers or a single practicing lawyer, AI can balance the costs of legal research while maintaining a consistent level of quality.[4]

Artificial Intelligence can equip lawyers with efficient tools to help them become better at advising clients as well as help clients access real-time information about the progress of their transaction. It can also be used in online dispute resolution, task management, securing documents and so much more beyond the human imagination.

? Online Research Bases And Digital Contracts

Technology can help in legal research by providing easy access to information and materials. The provision of soft wares like; LegalX , LawPavilion and Legalpedia Nigeria Limited has not only aided in legal research but also in the storage of documentaries and proper case management. Additionally, in Nigeria, through the introduction of e-signature by the Company and Allied Matters Act, 2020[5] digital contracts has been made feasible in professional organizations and in the conduct of business.

? The Use Of Technology In Will Writing

Today, creating an electronic will is now possible through the help of electronic signatures and videos. Videos can serve as a useful tool for documenting testator intent when extrinsic evidence is needed to corroborate ambiguities in the will language or to understand strange bequests. If a relative decides to challenge a will, a video explanation can serve as proof of what the testator intended and be used to show that the testator was mentally competent. Videos can also be used to document the will execution process and serve as proof that all the will was signed, notarized, and attested properly.

? Virtual Hearings

Remote hearings have proven to be practicable during the COVID-19 pandemic. Hearings done online tend to be faster and will also reduce the cost of litigation. It has also shown promise in the field of Alternative Dispute Resolution as disputes between parties are now settled through Online Disputes Resolution which may be more efficient.

CONCLUSION

In conclusion, technology has come to stay in the legal profession and its use should be highly encouraged rather than feared. Noah Waisberg, Chief Executive Officer and Co-founder of Kira Systems, said: “I believe the future will be about harnessing technology – as well as appropriate people and process – to solve new legal problems, problems which look now essentially unsolvable”. It therefore means that legal professionals need to adapt, acquire and enhance their skills in order to remain competitive and relevant in this technological revolution era.
