How to assure timely issuance of a White Report

Why do I need to know what "MMD" means ?

If you are a real estate developer and have never developed a Condominium Project or a Planned Development and you need to create homeowners association as well as secure a White Report from the California Department of Real Estate ("DRE"), you need to ask the attorney you want to hire if he/she has approved MMD'S on file with the DRE.

If the answer from the attorney is "no", this is not good for timely issuance of a White Report.

"MMD" means Master Management Documentation. The DRE will approve documentation prepared by an attorney licensed to practice law in California for single phase or multi-phase Planned Developments and/or Condominium Projects and then issue an approval with an assigned number. The developer's attorney needs to sign an MMD Attorney Certification and attach a copy of the DRE approval of his/her documents which is then submitted to the DRE for a White Report.

Title insurance companies have Builder Services Departments which submit documentation for a White Report. These departments prefer to work with an attorney with MMD documents approved by DRE. Why ? The DRE Special Investigator assigned to review the documentation will require compliance with the DRE Regulations included in Title 10 of the California Administrative Code. This is different from the Davis-Stirling Act (California Civil Code Section 4000 et. seq.).

Knowing about the Davis-Stirling Act is helpful, but not the determinative. Having MMD documents expedites DRE approval of your Project. Its that simple.

Do I have MMDS on file with DRE ? The answer is "Yes".
