Deadline Now Jan. 1, 2021 for Sexual Harassment Prevention Training to Rank-and-File Employees
By last month’s amendment to California’s Government Code, there is now a one-year extension to January 1, 2021 for all employers with five or more workers to first provide at least one hour sexual harassment prevention training to all nonsupervisory personnel and two hours minimum to supervisors. Such employers must then deliver this instruction in every other year following.
Beginning Jan. 1, 2021, new hires must be trained within six months of their start date and supervisors within six months of their taking such position.
One deadline has not been changed. Beginning January 1, 2020, affected employers will have to train seasonal and temporary employees within 30 calendar days of hire or before the individual works 100 hours, whichever is sooner.
While the “drop dead” date on most instruction is now put off, there are good reasons to initiate this training as soon as possible. The Government Code also requires California employers with one or more employees to take “all reasonable steps necessary to prevent discrimination and harassment from occurring.”
The law is particular on training content, to include not just information but practical guidance on federal and state “prohibitions against and the prevention and correction of sexual harassment in employment.” Instructors must be expert in such prevention and must include gender identity, gender expression and sexual orientation as part of the training.
This mandatory training law also has a broad definition of “employer,” any person regularly employing five or more persons or regularly receiving services of five or more persons providing services pursuant to contract,” i.e., independent contractors.
