Sole trader £1900.00 Self-Assessment issue
Our client was referred to us via an accountant, who had tried to get a payment plan agreed for their client and unfortunately failed. HMRC were stating he was going to be made bankrupt and that before that, a field force agent would remove all goods from the salon.
The client ran a hairdressing business but as sole trader not as a LTD, leasing premises and some equipment (but not all) and also employing around 5 staff.
Their issues arose as the landlord for the shop entered into bankruptcy action himself and as he owned the store, all his premises were being frozen via the bankruptcy proceedings, with no guarantee of the lease being carried on.
Our client had fought for 6 months before being referred to us, trying to get the lease agreement carried on and fighting HMRC in the background, as all available funds had been used to keep the staff on, keep customers coming in and also a significant sum had been spent trying to get the right legal advice surrounding the leased premises.
Now although we don’t profess to be solicitors we do have a network of contacts that cover a broad range of services in order to support our clients. Once the client was referred to us we ensured they got the right legal advice, as the last thing the client needed was the cost of moving premises.
All his money that had been for his self-assessment had been eaten away owing to all the above issues and as the accountant had tried a time to pay request, HMRC were literally blanking the client, adamant that he was about to be made bankrupt.
We established that his debt was not even at the stages of field force being able to come to the premises, let alone remove goods, we also established that HMRC were still in a position to discuss a payment plan.
£1900 may not seem a lot but it is when you’ve nothing to pay towards it.
Our Solicitor was supporting the client separately and we got HMRC to agree to an extremely low monthly payment to begin with, only £100 per month, till everything else was settled. Our agreement with HMRC meant that the client had 6mths breathing space, to resolve everything else & then we would review everything for him.
HMRC conceded that they had not helped this client, given the difficult situation and an agreement was met.
