Hamara Sankalp Viksit Bharat Series | 1.Judicial Reforms needs to be brought!

Dear Friends, I am starting a series HSVB(Hamara Sankalp Viksit Bharat) by 2047 and the first article on my news letter towards this series pertains to the need of Judicial Reforms that are to be brought at the earliest. I shall pen down them one by one at succeeding paragraphs for your perusal for Indians and their comments please so that they could be forwarded to the GoI and to our Hon'ble Prime Minister Shri Narendra Modi ji's kind perusal and consideration. Before I start that I must admit that a great job has been done that was waiting from last 75 years after the independence, that is implementing 03 New Laws and they are very effective and they offer a biggest blow to the colonial mind set and throwing away the old archaic laws that were made by the British to rule Bharat and to commit atrocities on Bharatwasi. It is indeed an amazing achievement at a right time and I must compliment Hon'ble Prime Minister, Hon'ble Home Minister and Hon'ble Lok Sabha and Rajya Sabha for the same. I now start my recommendations one by one as they are the need of the day as I feel in my individual capacity as Bharat has achieved so much in last 10 years that they are must so that the nation unleash its full potential living up to the immense capabilities each Bharatwasi has.

1. The Law with a provision of a verdict with in a year- That each case at any court must not prolong more than a year and verdict be announced with in a year.
2. The spread of negativity, hate speeches, speaking lies with no basis and speaking against the nation by any one or by a group or by a political party or speaking ill about Bharat Civilizational Value System based on Sanatan Dharma in public or privately in India or Abroad must be made a non-bailable offence with a provision of 10 years of rigorous imprisonment, though it must be made explicit explaining offences in details & minutely with gravity attached in each case. Speaking lies or spreading lies must be made a very serious offence with an adequate provision for the punishment. The lie detection through Narco Brain Mapping Test must be made compulsory and also as an instrument of evidence needed at any court.
3. Strict laws with a provision of Fast Track Courts must be made to deal with fabricating , making false / fake or duplicate Aadhar Card, Ration Card, License, Passport, or any other document for the purpose for an intrusion / or an illegal entry in to Bharat must be made a Non-Bailable Offence with a provision of Life Sentence to the ones who make them or facilitate and also who gets them made or possessing such fake documents. The similar law for the adulteration in food products, medicines / drugs, or any other product that is used for the Human Consumption as well as for animals needs to be made. The similar laws who kills or poach wild animals. Similar laws to be made for the forced conversion using authentic or fake identities by luring through any methods.
4. The number of judges be increased at each court so that vacancy remains and more appointed as needed, so, no case remains pending at any courts by the end of 2028 as Digitalization is already underway at a massive scale.
5. The laws made by the Congress towards the appeasement of Muslims must be repealed at the earliest whether it is Wakf Board Act, Puja Sthal Act, or adding words such as Secular & Socialism to the preamble of the constitution. NRC must be implemented nation wide by the end of 2025.
6. UCC must be passed by 30 Jun 2025 along with a provision of Population Control built in it explicitly.
7. Leaking of question papers of any exam at any level and involvement in taking bribe in any exam, or selection system/procedure must be made a Non Bailable Offence with a strict provision of Life Imprisonment as it is needed in order to ensure that a right person for a right job gets selected and for nurturing the right talent for makin a Viksit Bharat by 2047. Fast Track Court with a provision that verdict is given at each court with in a year including disposal of appeals.
8. The corruption at any level must be dealt as a Non-Bailable Offence and Law with a provision of awarding a Verdict with in a year through Fast Track Courts and all appeals must get exhausted with in a year at each court and the case right from lower court to Hon'ble SC must not take more than 03 years.
9. One Nation One Education & One Syllabus bill to be passed by 30 Jun 2025 so that equal opportunity is provided to all with out any bias created due to influence of money.
10. Ayushman scheme with a provision of Rs. 5.0 also be extended to all whose income is less than 06 lakh per annum till FY 2027 and than this limit to be extended up to an income of 10 lakh per annum from 01 Apr 2027 onwards till 30 Jun 2029. After than a review needs to be taken and made sure how it could be extended up to an income of Rs.15 lakh per annum.
11. Resolution under IBC must be over with in 02 years rather than 03 years and any intervention by NCLT, NCALT, DRT, CAT, Courts, HHC, HSC in between when resolution is on must not take more than 06 months as Asset value of NPA accounts must not get affected or reduced during resolution. It is seen that asset value in all the big accounts more than rupees 1000 Cr that turned in to NPAs and then got resolved under IBC is very low in comparison to the loan amounts extended to them by the PSBs or the amounts of NPAs outstanding against them and I am really not only surprised but bewildered that what policy was followed by the PSBs during UPA-I & UPA-II time while PSBs extending loans to the corporates with no accountability between 2004-2014. I must mention it here that this situation during UPA regimes derailed Indian economy at least by $ 01-$1.5 trillion by 2014 itself.
12. The family trusts, children trusts and any kind of assets of a promoter and the responsible Board of Directors & Any Official under an offence under PMLA / FCRA or IBC must be made applicable towards recovery of loans from banks and provision of 10 years of rigorous imprisonment for hiding money or siphoning of money must be made in order to stop misuse or loot of public money.
13. These are my personal views with an attempt to put across them if they have some merit directly or with some changes but Judicial Reforms are must and so is the need of a Judicial Charter for the people of Bharat so that they discharge their expected responsibilities towards nation so that our aim of becoming a Viksit Bharat by 2047 with an economy of $38 trillion gets realized.
14. The Land procurement and buying of properties must be linked with Aadhar Cards at the earliest.
15. DRTs, DRAT, NCLTs, NCALT, AFTs must have adequate manpower so that the delays in disposal is reduced and asset value does not get eroded.
