H1b VISA Filing Steps

The H-1B visa is a non-immigrant visa that allows U.S. companies to employ foreign workers in specialty occupations. Here are the general steps to file an H-1B visa:

  1. Find an employer who is willing to sponsor your H-1B visa. The employer must first file a Labor Condition Application (LCA) with the U.S. Department of Labor (DOL) to ensure that the employer will pay the prevailing wage for the job.
  2. The employer then files a petition for a non-immigrant worker, Form I-129, with the U.S. Citizenship and Immigration Services (USCIS). The petition must include the LCA, the job offer letter, your resume, and other supporting documents.
  3. Once the petition is approved by USCIS, the employer will receive a Form I-797, Notice of Action, which confirms the approval of the H-1B petition.
  4. The employer will then send the Form I-797 and other required documents to you, and you will need to schedule a visa interview at the U.S. embassy or consulate in your home country.
  5. Attend the visa interview and provide all required documentation. This may include the Form I-797, your passport, your education and work experience certificates, and other supporting documents.
  6. If the visa is approved, you will be issued an H-1B visa stamp in your passport, and you can then travel to the United States to begin working for the employer.

It is important to note that the H-1B visa process can be complex and may require the help of an immigration lawyer. The process also has annual quotas, and it is highly competitive, so it is important to start the process early and ensure that all paperwork is completed accurately and on time.
