Guide to the Right to Information (RTI) Act, 2005 in India

The Right to Information (RTI) Act, enacted in 2005, is a transformative law that empowers citizens to access information held by public authorities, promoting transparency and accountability in governance. Below is a comprehensive guide to understanding and utilizing the RTI Act in India:

What is the RTI Act?

The RTI Act provides the right to citizens to seek information from public authorities, thereby making government functioning more transparent. It is a tool to combat corruption and enhance governance.

Key Features of the RTI Act

  1. Applicability: Covers all constitutional authorities, including executive, judiciary, and legislature. Extends to all levels of government—Central, State, and local bodies. Excludes intelligence and security organizations under the Second Schedule, except in cases of allegations of corruption or human rights violations.
  2. Public Authorities: Includes any authority or body constituted by or under the Constitution, laws made by Parliament/State Legislatures, or bodies substantially financed by the government.
  3. Right to Information: Inspection of records. Taking notes, extracts, or certified copies of documents. Obtaining information in the form of diskettes, floppies, tapes, or electronic formats.
  4. Exemptions: Information affecting national security, sovereignty, or public safety. Personal information without public interest. Trade secrets or intellectual property if disclosure harms competitive position.

How to File an RTI Application?

  1. Identify the Public Authority: Determine the government department or public body that holds the required information.
  2. Draft the Application: Write the application in English, Hindi, or the official language of the state. Clearly mention your queries in a specific and concise manner. Include your name, address, contact details, and the period for which information is required.
  3. Submit the Application: Submit to the Public Information Officer (PIO) of the concerned authority. Applications can be sent via post, in person, or through online RTI portals where available.
  4. Pay the Fee: A nominal application fee of ?10 (varies for online submissions). Additional charges for photocopying or document delivery as applicable.
  5. Receive the Response: PIO must respond within 30 days (48 hours for life and liberty matters). If no response is received, it is considered a deemed refusal.

Appeals and Complaints

If the information is denied or unsatisfactory:

  1. First Appeal: File with the Appellate Authority of the same department within 30 days.
  2. Second Appeal: Escalate to the Central or State Information Commission within 90 days.
  3. Complaint: Lodge a complaint directly with the Information Commission for issues like non-appointment of PIOs or refusal to accept the application.

Role of Information Commissions

  • Central and State Information Commissions ensure compliance with the Act.
  • They can impose penalties on erring officials (up to ?25,000 for non-compliance or malafide denial).

Benefits of RTI

  1. Empowers citizens to question authorities.
  2. Enhances transparency and accountability in governance.
  3. Reduces corruption by exposing irregularities.
  4. Helps in policy analysis and decision-making by providing factual information.

Challenges in Implementing RTI

  1. Backlog of Cases: Overloaded Information Commissions with pending appeals and complaints.
  2. Lack of Awareness: Citizens often unaware of their rights and processes under the RTI Act.
  3. Resistance from Authorities: Bureaucratic hurdles and reluctance to share information.

Tips for Effective Use of RTI

  1. Be precise and clear in framing queries.
  2. Avoid asking hypothetical or opinion-based questions.
  3. Follow up on appeals if information is delayed or denied.
  4. Use RTI judiciously to seek public interest information.

The RTI Act is a powerful tool to ensure transparency in Indian governance. When used effectively, it strengthens democracy by holding public officials accountable and empowering citizens to make informed decisions.
