Government to reform DoLS with new Liberty Protection Scheme
The Final Government Response to the Law Commission's review of Deprivation of Liberty Safeguards and Mental Capacity is now available here. Most of the Law Commission's recommendations have been accepted by the Government, but how long will we be waiting for new legislation to come into force? Only time will tell:
"We agree in principle that the current DoLS system should be replaced as a matter of pressing urgency and we have set out our provisional stance regarding each specific recommendation below.
We will legislate on this issue in due course. However, before the introduction of any new system, we will need to consider carefully the detail of these proposals carefully and ensure that the design of the new system fits with the conditions of the sector, taking into account the future direction of health and social care."
