The July 2024 HMRC update warns that many salary sacrifice schemes claiming workplace nursery tax exemptions fail to meet the required criteria.
Issues arise from insufficient employer involvement in financing and managing the nurseries, which could lead to improper reductions in National Insurance Contributions (NIC) and tax underpayments. Employers must be actively involved in both the financial and managerial aspects to qualify for the exemption.
The workplace nursery tax exemption was originally introduced in 1990 to encourage employers to directly provide nursery facilities for their employees’ children, typically through salary sacrifice.
