China BWS Market Update - Days after the European Union (EU) voted to impose tariffs on Chinese-made electric vehicles (EVs), China's Ministry of Commerce (MOC) announced on October 8th that temporary anti-dumping measures will be imposed on brandy originating from the EU, requiring importers to pay a cash deposit on their purchases. Effective from October 11th, importers of EU brandy must place deposits with Chinese customs based on dumping margins ranging from 30.6% to 39.0%, varying by different suppliers. According to a preliminary assessment published on August 29th, following an investigation that began in January, the MOC determined that brandy imported from the EU is being sold in China below its fair value, which constitutes dumping. Additionally, the ministry noted that the domestic brandy industry is facing a significant threat of harm, establishing a direct link between the dumping and this threat. The measures apply to brandy distilled from grape wine in containers of less than 200 liters, primarily intended for direct consumer use. FDA Registration & Renewal – The FDA has issued the reminder for mandatory biennial registration and renewal for Food Facilities between October 1st and December 31st, 2024. In order to complete the renewals of an existing registration, access the FDA website at: fda.gov and click on the FOOD tab and under MOST POPULAR select BIENNIAL REGISTRATION RENEWAL FOR FOOD FACILITIES. If you have never registered before, and you are involved in transporting food stuffs to the United States, now is the time to register in order to avoid delays and issues. Failure to register or renew can result in shipments being refused entry into the US economy. Thankfully, the process is simple and streamline and does not take long to complete.

Hurricane Milton - Hurricane Milton made landfall late Wednesday night on Florida's West Coast near Siesta Key. Milton made contact at a Category 3 and has gradually decreased in severity as it has made its way across land to the East Coast. Rain and heavy winds continued to rage throughout Thursday, and flood warnings are still in effect. Ports impacted by the hurricane include Port of Tampa, Port of Key West, Port Canaveral, Port St. Pete, and Jaxport - all of which are still operating under condition ZULU meaning no vessel operations can take place. While most of these ports are cruise-centered, transportation delays may still be expected due to roadside operation difficulties and infrastructure damage. We send our thoughts to all those impacted by the hurricane and its aftermath and hope for a swift restoration of the damaged regions.

ILA Update – With US ports back in operation, we are seeing steamship lines cancel the congestion fees that they previously announced in the lead up to the ILA strike. While we are out of the woods for the time being, the Master Contract extension is only until January 15, 2025, which will be here sooner than we think. For now we have the peace of mind of normal operations but it is worth keeping in mind that disruption on the East Coast could potentially resurface. We will continue to monitor this situation and provide updates accordingly.

Chile – The pass connecting Argentina and Chile opened for transit yesterday after four days of closure due to bad weather. Although the traffic is flowing, there is a great deal of truck congestion on either side of the pass, which will take some time to work through. If you have shipments waiting to transit the pass, please plan for additional time as the backlog is cleared.

South Africa - Delays continue in South Africa as port operations are constrained due to inclement weather conditions and equipment breakdowns and shortages. Strong winds, high swells and vessel ranges created the majority of operational constraints at the Port of Cape Town, and Durban Port is also experiencing issues due to weather and equipment damage. We will continue to monitor this region and provide updates accordingly.
