Project: Support for regulatory planning and alignment with the EU acquis in critical policy areas

The Deutsche Gesellschaft für Internationale Zusammenarbeit GmbH (GIZ) is a federal enterprise that supports the German Government in achieving its objectives in the field of international cooperation for sustainable development. The objective of the SFF is to provide support to the Government of Albania (GoA) in enhancing regulatory planning and alignment with the EU acquis in critical policy areas, specifically focusing on the Internal Market, Agriculture, Transport, and Environment Policy sectors.
Its support will focus on 3 complementary Intervention Areas:
1) Regulatory gap assessment and analysis. Support will be provided to conducting in-depth regulatory gap assessments for selected priority areas within the Internal Market, Agriculture, Transport, and Environment Policy sectors and to ensuring the identification and documentation of regulatory gaps relative to the policies at stake. Also, support will be provided for integrating identified gaps into the national strategic planning, thereby facilitating the incorporation of regulatory gap assessments into the National Plan for EU Integration (NPEI) and ensuring seamless alignment of identified gaps with the overarching national strategy for EU integration.
2) Progress in regulatory alignment with the relevant acquis. Support will be provided to draft strategic legislation that will be necessary for advancement of harmonisation work in the frame of EU accession within the Internal Market, Agriculture, Transport, and Environment Policy sectors and for ensuring active collaboration and coordination among the respective working groups for effective alignment efforts. This will be done through expert advice and capacity building measures for drafting of concept notes/strategic regulatory frameworks by guaranteeing on the same time that sound regulatory impact assessments (RIA) are carried out and gender equality aspects are taken into consideration.
3) Enhanced capacities in regulatory alignment. Support will be provided for on the job training and capacity building to the Line Ministries staff on the EU acquis and the process of legal alignment including the preparation of the tables of concordance between the proposed draft acts and the relevant EU acquis.
The measure complements the interventions of the ongoing Project “Support to Accession Negotiations in Economic Chapters of Acquis (SANECA II).

The Legal Advisors will provide support to the Ministry of Finance and Economy (MFE) team. The focus will be on activities pertaining to legal approximation within the EU acquis policy areas of Internal Market Cluster on free movement of goods, services and workers, consumer protection, company law and state aid.
A. Responsibilities
The incumbents are responsible for:
??????????? Conducting a thorough review and assessment of both the EU acquis and pertinent national legislation to pinpoint gaps within the national legal framework in comparison to the EU acquis.
??????????? Advising MFE/line ministries on the requisite measures essential for aligning national legislation with the EU acquis.
??????????? Supporting in the drafting of the regulatory package for acts earmarked for alignment with the EU Acquis as prioritised in the National Plan for European Integration.
??????????? Providing hands-on training and capacity-building for MFE/line ministries' staff on the EU acquis and the legal alignment process.

?The advisors perform the following tasks:
?B. Tasks
1.??? Regulatory planning and alignment
The incumbents:
·???????? Conduct analysis of existing national laws to identify areas that require alignment with EU standards. Assess the compatibility and compliance of national legislation with relevant EU directives, regulations, and treaties.
·???????? Identify gaps or discrepancies between national laws and EU acquis. Provide reports outlining the specific areas that need adjustment or amendment to achieve alignment.
·???????? Support in drafting and proposing amendments to existing national laws to bring them in line with EU requirements.
·???????? Ensure the assessment of the potential impact of proposed legal changes (RIA) on various stakeholders, industries, and the general public (including consideration of gender equality aspects), to ensure informed decision-making.
·???????? Stay informed about the latest developments in EU acquis. Monitors updates, amendments, and new directives from EU institutions that may impact national legislation.
·???????? Offer expert legal advice to government officials and decision-makers on the interpretation and application of EU law.
·???????? Provide ongoing consultation to address legal intricacies and facilitate informed decision-making.
·???????? Proactively identify and address challenges related to legislative alignment, offering solutions and mitigation strategies.

2.??? Management, coordination and collaboration
The incumbents:
·???????? Oversee and coordinates activities related to regulatory planning and alignment in close collaboration with the horizontal EU negotiation managers, including the Chief Negotiator's Office (ChNO) and the PMO Department for Policy and EU Integration and SANECA II project team to ensure cohesive and harmonized approaches to EU integration efforts.
·???????? Collaborate with technical/regulatory unit(s) within the Ministry of Finance and Economy (MFE) to support alignment efforts.
·???????? Participate in interdepartmental/interinstitutional meetings to discuss the implications and implementation of EU directives.
·???????? Facilitate communication and collaboration among relevant stakeholders, including line ministries and working groups. Foster a collaborative and supportive team environment.

3.??? Capacity building, Knowledge management, Reporting, and Documentation,
The incumbents:
·???????? Provide capacity-building measures for legal professionals, government officials, and stakeholders to enhance understanding of EU legal requirements.
·???????? Enhance internal capacity within government institutions to navigate and sustain compliance with EU acquis.
·???????? Facilitate knowledge transfer by employing established methodologies and formats, ensuring alignment with best practices and standards.
·???????? Contribute to the development and dissemination of best practices in regulatory planning and alignment within the specified critical policy area.
·???????? Prepare regular reports detailing the progress of alignment efforts, challenges faced, and recommendations for improvement.
·???????? Maintain accurate and organized documentation of legislative changes, correspondence with involved institutions/stakeholders, and related materials.
·???????? Ensure that all relevant legal documents are readily accessible for reference and further regulatory work.

4.??? Other duties/additional tasks
The incumbents:
·???????? Provide guidance on engaging in consultations with stakeholders before drafting new legislation to gather diverse perspectives and insights.
·???????? Develop communication strategies to raise public awareness about legislative changes, fostering transparency and understanding.
·???????? Undertake any additional tasks or responsibilities deemed necessary for the successful implementation of the program.

C. Required qualifications, competences and experience
·???????? Education/Training: Master’s degree or equivalent in EU law or other relevant field of law. ?
·???????? Professional experience: 5 years of general professional experience in regulatory and/or policy field out of which 3 years of direct hands-on involvement in regulatory drafting and/or alignment in any of the above-mentioned policy areas of Internal Market Cluster acquis. Experience in the policy areas of free movement of workers, company law and state aid is considered an advantage.
Other competences:
o?? Proven track record of successfully coordinating and engaging with diverse stakeholders, including government departments, agencies, civil society organizations, and international partners.
o?? Strong project management skills, including the ability to manage multiple projects simultaneously, prioritize tasks, and meet deadlines.
o?? Experience in preparing reports, briefings, and presentations on policy-related matters.
o?? Excellent communication and negotiation skills, with a focus on facilitating collaboration and consensus-building among stakeholders in the regulatory process.
o?? Excellent knowledge of written and spoken English.
o?? Very good working knowledge of ICT technologies and computer applications.
