GIFT OF LAND TO SCHOOL FOR USE AS A PLAY-GROUND WITH CONDITION FOR REVOCATION ON BREACH OF COVENANT BY DONEE

THIS DEED OF GIFT made the ________ day of __________

_________________________________________________ (insert the name, address, etc. of donor) (hereinafter called the trustee) of the ONE PART

AND

_______________________________________________ (insert the name, address, etc. of?donee) (hereinafter called the donee) of the OTHER PART.

WHEREAS the Donee is the manager duly constituted of the __________________ School and has requested the Donor to transfer to the said school the plot of land measuring _______ square feet lying at the back of the said school for the purpose of the same being used by the school as a play-ground.

AND WHEREAS the Donor has agreed to transfer to the Donee the said plot of open land more fully described in the Schedule hereunder written and coloured red on the map or plan annexed hereto (hereinafter referred to as “the said property”) without any consideration.

NOW THEREFORE THIS DEED WITNESSES that in pursuance of the said agreement and in consideration of the purpose for which the said property is needed by the Donee, the Donor as beneficial owner does hereby grant, convey and transfer by way of gift to the Donee and his successor-in-office ALL THAT the piece of land more fully described in the Schedule hereunder written and coloured red on the plan annexed hereto and hereinafter referred to as “the said Property” TO HOLD the same unto the said Donee or his successor-in-office as long as the said property hereby transferred shall be used for the purpose of a play-ground for the said school or any other school to which the said school may be merged or made part of AND the Donee does hereby accept the said gift subject to the condition that if the Donee or his successors-in-office cease to use the said property for the use and benefit of the said school as provided herein this gift shall be revoked and the said property shall revert to the Donor.
