In late 2021, the Chartered Institute of Arbitrators Australia (CIArb) and Delium Limited conducted a survey to identify the challenges and opportunities technology delivers to alternative dispute resolution.?

The objective was to discover “What Arbitrators and Counsel Really want from Technology in Virtual and Hybrid ADR”.

The paper analyses the data and offers opinions on how sector participants adapt to new technologies and new ways of working – the challenges they face, identified opportunities for experience enhancement, and future intentions.

The main findings are as follows:

Virtual and hybrid hearings and mediations will increase, with or without ongoing travel restrictions.

The key challenge facing virtual ADR is a lack of knowledge about:

• how best to conduct virtual ADR processes, and
• the availability and use of suitable technology. Video conferencing and screen-sharing tools are inadequate.
• the availability and use of suitable evidence presentation technology. Users want the ability to interact with evidence presented in the virtual realm in the same way they do in a traditional forum.
• how to assert and assess witness credibility and integrity, as well as the practical management of remote witnesses using technology.

Respondents identified a range of compelling benefits of virtual hearings, including flexibility of location and time zone, convenience, cost reduction, and better access to justice.

Two key capabilities considered highly desirable are:

• the automatic capture of the record of presented evidence; and
• post-hearing arbitral access to the transcript linked to evidence for the purpose of writing the arbitral award.
