Consumer data and the legislation governing it have caught a lot of headlines this year. One of them was regarding the Geofence warrants. It enables law enforcers to acquire information on all functioning devices in a specific geographical location at a specific time.???

A geofence warrant helps find evidence that can potentially resolve the crime. Yet, it puts sensitive user information at risk, even that of innocent people who happened to be nearby when a crime was committed.???

Google partially acknowledged this issue in its recent announcement. It stated that the option for users to store data on their devices can be secure. This move forces police to access a specific device rather than every device in an area.?

Being the biggest collector of sensitive user information, Google is the first company to be tapped for this issue. Yet, it isn’t the only company subject to Geofence warrants. Tech giants like Yahoo and Microsoft also receive them.???

Sensitive user information is the most precious commodity on the internet. Advertisers are willing to pay top buck for it. Google, for instance, sells user information to drive its advertising business. Yet, it does not like geofence warrants.???

Apple, in its 2022 transparency report, stated that it received 13 geofence warrants to which it failed to respond as the data resides locally and is inaccessible.??

The news about Google shifting user’s location data to their devices received praise. Yet, it is not a permanent solution to the problem. Officials can still tap their doors for the historical data that they have in store. Unless Google decides to delete it.???

While one may favor consumer privacy, law enforcement can’t be overlooked. This issue can be a possible challenge for the judiciary. A geofence warrant can mitigate the hassle of rigorous investigation. Yet, its usage must be regulated to ensure user privacy.??
