Gender Bulletin [06/01/2025 to 10/01/2025]

  1. Anand Pawar, Registrar of Rajiv Gandhi National University of Law (RGNUL), Patiala, has been suspended over allegations of sexual harassment, bigamy, and administrative misconduct. The suspension order cites his involvement in a second marriage despite pending litigation with his first wife, misuse of his position for personal benefits, and violations of university regulations. Additionally, he faces a ?3 lakh penalty following a sexual harassment complaint by an Assistant Professor upheld by the Punjab & Haryana High Court.
  2. The Allahabad High Court in Salman vs. State of U.P. denied bail to a man accused of forcing his wife into prostitution by compelling her to have physical relationships with his friends and others. Justice Sanjay Kumar Singh observed that such allegations are a serious blow to the victim's dignity, honour, and self-esteem, leaving behind a traumatic experience. The court emphasised that the case extends beyond a simple matrimonial dispute, given the gravity of the offenses alleged.
  3. The Karnataka High Court in Karnataka Federation of Women Lawyers & Anr. v. State of Karnataka & Ors. dismissed petitions seeking 33% reservation for women advocates in the Advocates' Association Bengaluru (AAB) elections, scheduled for February 2, 2025, citing its lack of authority to intervene in ongoing election processes without existing bylaw provisions. The Court noted that only the Supreme Court, under Article 142, possesses the power to mandate such reservations. The AAB indicated it would consider amending its bylaws to include reservations for women after the upcoming elections.
  4. The Bombay High Court criticised a couple seeking to terminate their adopted daughter's 20-week pregnancy, questioning their parenting and the claim of her mental instability. The Court noted the daughter's diagnosis of borderline personality disorder linked to depression, not mental retardation, and emphasised the necessity of her consent for any abortion. The judges highlighted the parents' neglect and stressed their responsibility towards their daughter.
  5. The Bombay High Court has ordered an enquiry against a Police Sub-Inspector (PSI) who sent a Facebook friend request to a complainant woman involved in a case he was investigating. The Court expressed concerns over the PSI’s actions, questioning his motives and the appropriateness of using social media in such a context. The Court directed the Deputy Commissioner of Police to investigate and take necessary action regarding the officer's conduct.
  6. The Supreme Court of India in Supriyo v. Union of India has dismissed review petitions challenging its October 2023 verdict that refused to recognise same-sex marriages or civil unions, stating there was no error apparent in the judgment and no interference was warranted. The Court maintained that the right to marry is not a fundamental right for same-sex couples, leaving any potential legalisation to Parliament. Additionally, the Court upheld its decision that same-sex couples do not have the right to adopt children under current law.
