GDPR. What changes in the management of personal data

Dear friends,

The New General Data Protection Regulation (GDPR) wants to be a user-friendly tool that creates a relationship of trust and responsibility between the natural persons from whom the data originates, and the operators who collect, process or store them. 

The text of the Regulations sets out the scope of the Regulation, giving it the possibility to apply worldwide, with the aim of increasing the protection of the rights of the persons concerned, from which the data originates and from whom they are transferred, by promoting an extension of the effects to operators/data collectors whose headquarters are outside the EU.

The complexity of the Regulations and the newly introduced concepts revolve around three basic principles that the GDPR has consolidated and whose scope it has extended:


# 1 The New Regulations create a transparent framework for the subjects from which data is collected, ensuring that individuals have a much more active and easy role in the direct exercise of their rights, such as instant withdrawal of consent; request for deletion of data and, at the same time, possibility of transmitting data from one operator to another.


# 2 The New Regulation renounces the excessive formalism and bureaucratic barriers imposed on obtaining the authorization for the transfer of data, leaving at the same time the possibility for States to establish their normative framework (guides, standards of application) in order to provide an adequate level of protection. This fact is very beneficial from the point of view of the major judges at the international level who have at their disposal a unitary policy and unique transfer and security procedures, without having to face legislative obstacles.


# 3 Notifications and transfer authorizations will thus become old history after May 25, 2018. These will remain in our memory as rudimentary means of transfer.
