Leaking Petroleum Storage Tanks (LPST)

There are many ways a hazardous or petroleum-based substance can make its way into the surrounding area from underground storage tanks, primarily through leaks, spills, and overfills. A site I own got contaminated, but it wasn’t my fault!

 The Texas government has allowed for exactly this circumstance with the Texas Innocent Owner/Operator Program. If contaminants migrated onto a property from sources located elsewhere, and the owner of said property did not cause or contribute to the sources, they may be eligible for an IOP certificate. This is a similar release of liability to the VCP, but does not transfer to future owners/operators.
