  • When to file: File as soon as it’s published
  • Takes about one week to prepare and file, 9-18 months for Examination
  • Last for 70 years from creator’s death, or 100 years for corporations


3) PATENTS

  • “Any” apparatus or process, recent “judicial exceptions” currently pending in Congress
  • When to file: File as soon as possible -- the US Is a First to Invent Country
  • Takes about one week to prepare and file provisional, about four weeks for a design, about 4-6 weeks for a utility application. Add 9-18 months for first Examination, double the time for correspondence and USPTO visits. Can expedite but $$$
  • Last for 20 years from date filed


4) TRADE SECRETS

  • “Any” information that gives a competitive advantage and is secret
  • When to file: no filing, but must be able to demonstrate “protected secret” (NDAs, locks, tracking, etc)
  • Takes diligence to set up and maintain program
  • Last as long as the information is secret and gives competitive advantage
