The Fraudulent Speeding Ticket, Long Overdue

Last week on July 11, 2024, I received a voice message with a recorded note from someone who claimed to be from the City of Ottawa. The message was about one of the fraudulent speeding tickets arranged by senior members of Mr. Doug Downey's office, the Attorney General for Ontario. The recorded message can be listened to here:

This article talks about yet another episode of the long series of intimidation and retaliation tactics employed by the Ministry of the Attorney General ("MAG") to stop me from proceeding with the Motion for Leave to Appeal, before the Court of Appeal for Ontario.

The Message

The transcript of the message reads as follows:

This is an important message from the city of Ottawa's provincial offences camera infractions collections unit. It is important to contact the office by calling 613-580-3310 or toll free at 1877213310, to confirm if you have any unpaid infractions and to arrange payment for your overdue camera fine. Please call us back during our business hours Monday to Friday between 8:00 AM and 4:30 PM…Good bye.

The message referred to one of the speeding tickets that were issued fraudulently as I was preparing to file the Notice of Application for the Judicial Review, in the proceeding against Whitten and Lublin Employment Lawyers. I received a letter back in January claiming that a conviction had been issued against me due to unpaying the speeding camera infraction. I have described the details about the fake conviction and explained how a trial couldn't have taken place, let alone a conviction got issued, in an article: The Trial that Never Took Place.

I think it is helpful to re-iterate some of the points related to the fake conviction here:

  • The letter had a deadline for payment by February 11, 2024. The date of the alleged conviction was December 8, 2023.

Notice of Fine and Due Date

  • Before receiving the letter, I had an email exchange with the City of Ottawa on December 13, 2023, and I was advised that:

I can confirm that you are still currently eligible to request a trial for all three offences. I encourage you to submit your notice as soon as possible, as any delays may result in an automatic conviction for these offences and an inability for you to contest the matter in court.

  • On December 18, 2023, I filed a Notice of Intention to Appear, and received the following confirmation:

  • The Conviction Date on the Notice of Fine and Due Date was December 8, 2023. i.e. ten (10) days before I submitted and received a confirmation of the Notice of Intention to Appear before the court.

In other words, there was no trial that I was informed of. And the letter for the conviction was, essentially, fake.

The Timing

The timing of receiving the recorded message was not coincident:

  • July 10, 2024: I published an article on LinkedIn about the delay introduced by MAG, at Passport Canada, about a couple of passport applications, Misuse of Power, a Bipartisan Virtue, Part II
  • July 11, 2024 (morning): I published an article on LinkedIn on the costs award in the Judicial Review against Whitten and Lublin Employment Lawyers, The Cost of Seeking Justice
  • July 11, 2024 (afternoon): I received a recorded message from the City of Ottawa, asking me to check “to confirm if you have any unpaid infractions and to arrange payment for your overdue camera fine.”

Recurring Theme

Upon checking my phone records, it turns out that I received a call from the same number back on March 28, 2024:

Just like the second call, the timing of the first call was not a coincidence. That is, the following events took place during the week of March 25, 2024:

  • ?March 25, 2024: The office of the Chief Justice of the SCJ, acknowledged the receipt of the complaint against Madam Justice Laura Ntoukas (The Administrative Judge for the Small Claims Court). That was done six months after the complaint was first filed.
  • March 26, 2024: I sent a letter to the office of the Chief Justice expressing concerns about:

- The six-month delay in acknowledging my complaint.

- Shared a snapshot of the read receipt (RR) showing that the Honourable Geoffrey Morawetz had read the complaint on or about October 10, 2023.

  • March 27, 2024: I sent an email to the Divisional Court in Ottawa asking for the Affidavit of Service that I have been trying to obtain since January 12, 2024.

Concluding Remarks

The Ministry of the Attorney General, under Mr. Doug Downey's leadership, do not appear to see a problem in using, and misusing, the automated speed monitoring infrastructure, that was funded by taxpayers' money, to retaliate against people who have genuine concerns about Corruption, Collusion, and Abuse of Power. It won't be long before my license plate becomes due for automatic renewal as per the new process adopted in Ontario. In the unfortunate event that my plate renewal doesn't proceed as expected, there will be a follow-up to this article with additional and more recent updates on the topic.
