The Flexible Working (Amendment) Regulations 2023

Did you know The Flexible Working (Amendment) Regulations 2023 have been laid before parliament and come into force on 6th April 2024! Are you prepared?

The changes modify the 2014 Flexible Working Regulations, transforming to employees right to apply for flexible work into an immediate entitlement - starting on the 6th April 2024!

Until the 5th of April employees will still need 26 weeks of consecutive employment to be able to submit a request, but the requirement will be lifted on the 6th April 2024.

Although an official commencement order confirming this is still waiting, it is anticipated that the broader flexible working reforms from the Employment Relations (Flexible Working) Act 2023 will also take effect on the same date.?

These reforms encompass:

  • Allowing employees to lodge two flexible working applications within a 12-month period
  • Eliminating the necessity for employees to detail how their flexible work request will impact the employer
  • Mandating employers to engage in consultation with the employee before denying their flexible work application
  • Requiring employers to respond to flexible working requests within a 2-month timeframe.
