Fiscalization Essentials: Slovakia

The history of fiscalization in Slovakia is pretty long in this country since requirements for issuing fiscal receipts in retail have been introduced in 1995.

From the basic concept of fiscal devices usage (fiscal printers as the main type used by middle and big size retailers), in 2018. authorities had the intention to introduce the E-kasa system - a fiscalization concept based on certification of the POS application and real-time communication of transaction data with the authorities with a mandatory hardware component – protected data storage as a mandatory type of fiscal memory.

The rules are mandatory to be applied from July 1st, 2019, but no penalties were imposed if they were not met until the end of 2019.

Although, by the new law, there are no hardware requirements for the cash register itself, in practice, two types of solutions were developed:

  • ?a hardware solution including fiscal printer with software and the protected data storage altogether certified by the authorities and
  • ?a software solution certified only with the protected data storage hardware component.

Every store and POS are reported before the start of sale while real-time communication with the tax authorities refers to every particular transaction, no matter the type of the solution opted for.

If there is a failure of the online cash register, the entrepreneur is obliged to resume operation of this cash register within 48 hours of the failure or start using another online cash register.

?During the interruption of operation, the entrepreneur is obliged to make a receipt. The entrepreneur prepares it in two copies, while the original receipt is handed over to the customer. The entrepreneur is obliged to register the data from the receipts in the cash register whose operation was interrupted, no later than 10 days after the end of the month in which the operation was resumed.?

As you can conclude, there are many more details that must be understood properly to be able to create fiscal receipts in this country.

Specific numbers, codes, signatures, different identifiers, a whole set of data making the transaction:

  • tax-relevant
  • legal and?
  • unique

Besides that the latest update from May is that financial control inspectors will go to the field again, focusing on establishments that provide customers with catering services, i.e., canteens, restaurants and inns, whether they provide fiscal receipts

The only way to avoid possible sanctions is to ensure compliance with the law.?
