The first country in Asia to make strides in legalizing cannabis

Following the legalization of medical cannabis two years ago, the Thai government partially removed cannabis from the drug control list on February 8, becoming the first country in Asia to legalize cannabis.

According to the Thai PBS, Thailand’s public service broadcaster, on February 8, Anutin Charnvirakul announced that an official sign off for the elimination of cannabis from the country’s list of level five narcotics, with the exception of THC, a psychoactive substance that can cause high levels of nervousness, and cannabis extracts higher than 0.2% has been put in place. This has completely disconnected the relationship between cannabis and narcotics and is paving the way for home cultivation of cannabis in the country. It was also stated that this will take effect 120 days after the publication of the announcement.

Anutin Charnvirakul has been active in the push to legalize cannabis, foreseeing it becoming a cash crop for the country. He is the leader of the Thai Pride Party, the main cooperative party in Thailand's coalition government, and ran in the 2019 general election under the promise of helping farmers by legalizing cannabis production. Charnvirakul said that the objective of the Thai Ministry of Health is to elevate all parties to utilize cannabis and create value, including medical applications, research and development, and the development of the cannabis industry, and is fully intent on setting out greater work opportunities and income for Thai people.

Charnvirakul has also stated that Cannabis is very useful primarily in medical applications, so Thais will be able to grow it legally, for medical purposes, or commercially like other herbs, but it must be properly controlled, as cannabis is still considered a drug. According to the latest regulations, people can grow cannabis privately for commercial use after attaining a license from the government.

However, the recreational use of cannabis is still unclear as no specification in regards to this has been announced by the health minister. The Associated Press said that the production, sale and possession of cannabis in Thailand would remain partially regulated, and recreational use would likely remain banned due to the lack of confirmation. The official policy of the Ministry of Health, as of now, is mainly to promote the medical use of cannabis and to build an industry around its derivative products.

There is still, however, only vague mention of the legalities and policies of the possession of cannabis within the country. It is widely believed that the legal confusion implies that cannabis production and possession remain regulated until further notice, and recreational cannabis use could be, at best, in a gray area.

Thailand’s efforts on legalizing cannabis

Thailand started to advance the legalization of cannabis in 2018.

In 2019, the Thai government issued regulations to approve the use of cannabis in medical and research fields, allowing Category 5 narcotics (cannabis and kratom leaf plants) to be used in medical research, developing medical results, and for necessary treatment of some diseases under the supervision of doctors.

In 2020, Thailand further loosened up regulations in terms of medical cannabis, permitting doctors, patients, and practitioners of traditional remedies to apply for licenses to grow medical cannabis, and allowing medical product manufacturers to export medical cannabis products.

The regulations, as mentioned, have now completely removed cannabis from the control list, and untied cannabis from drugs, with the stated exception of cannabis extracts with a THC value higher than 0.2%. It is reported that beverage and cosmetics companies in Thailand have scrambled to launch products containing cannabis and cannabidiol (CBD) since cannabis has been officially legalized.
