Are Fee-Splitting Agreements Between Agents Legal?

I recently co-authored with Sofia Aguilar an article for AIR Commercial Real Estate Association’s monthly newsletter, AIRWaves, where we examine a recent decision by a California Court of Appeal upholding the legality of fee-splitting arrangements between agents is legal and binding, and that they do not require the broker to sign or approve. The decision, Sanowicz v. Bacal, is important because it finally addresses the legality of something many agents have been doing for years.
