四部门：强化财税金融政策支持 推进城镇环境基础设施建设

2月9日，中国政府网公布《国务院办公厅转发国家发展改革委等部门关于加快推进城镇环境基础设施建设指导意见的通知》。

其中，《指导意见》要求加大财税金融政策支持力度。落实环境治理、环境服务、环保技术与装备有关财政税收优惠政策。引导各类金融机构创新金融服务模式，鼓励开发性、政策性金融机构发挥中长期贷款优势，按照市场化原则加大城镇环境基础设施项目融资支持力度。支持符合条件的企业通过发行企业债券、资产支持证券募集资金用于项目建设，鼓励具备条件的项目稳妥开展基础设施领域不动产投资信托基金（REITs）试点。

China Accelerates Construction of Urban Environmental Infrastructure with More Fiscal, Tax and Financial Policies

The Chinese government released on February 9, 2022 the Circular of the General Office of the State Council on Forwarding the Guideline of the National Development and Reform Commission and Other Regulators on Accelerating the Construction of Urban Environmental Infrastructure.?
?
The Guideline called for adopting more fiscal, tax and financial policies and implementing preferential fiscal and tax policies with respect to environmental governance, environmental services, and technology and equipment for environmental protection. Financial institutions of various types are guided to innovate financial services, and development- and policy-oriented financial institutions are encouraged to increase financing support for urban environmental infrastructure projects by using the advantages of medium and long-term loans. Qualified enterprises are encouraged to issue corporate bonds and assets-backed securities to finance for the projects, and REITs pilot program would be steadily conducted for qualified infrastructure projects.?

上海首份《企业数据合规指引》出炉

近日，上海市杨浦区检察院联合市信息服务业行业协会、市数据合规与安全产业发展专家工作组、杨浦区工商业联合会制定发布上海市首份《企业数据合规指引》。
?
《指引》共38条，按照合规架构与风险识别处理的逻辑划分为六章，从数据合规管理体系、数据风险识别、数据风险评估与处置、数据合规运行与保障等方面引导企业加强数据合规管理。
?
《指引》还鼓励各类企业设置专门的数据合规管理部门，或者将数据合规管理职能融入现有的企业合规管理体系，但是不建议由法务部门履行合规管理职能。

Shanghai Releases Its First Guideline on Corporate Data Compliance
?
The Yangpu District People’s Procuratorate of Shanghai recently released the municipality’s first Guideline on Corporate Data Compliance, together with the municipal expert panel on data compliance and security industry development and the Yangpu Federation of Industry and Commerce.
?
Comprised of 38 articles set out in six chapters along the lines of compliance structure and risk identification and mitigation, the Guideline is intended to help enterprises step up data compliance management in terms of data compliance management system, data-related risk identification, data-related risk assessment and mitigation, and data compliance operation and safeguard.
?
In the document, the authorities also encourage enterprises to set up dedicated department for data compliance management or integrate this function to their existing corporate compliance management system. It is, however, not advisable to put legal department in charge of data compliance management, according to the Guideline.

上海发布商业广告代言活动合规指引 明确21项负面清单

近日，上海市市场监管局发布《商业广告代言活动合规指引》。《指引》从8个方面列举了对于《广告法》所称的以自己的名义或者形象对商品、服务作推荐、证明的判定标准。

此外，《指引》还从不能担任商业广告代言人的自然人、法人或其他组织，不得利用广告代言人或者部分特殊主体代言的商品或服务广告，广告代言活动不得出现的导向问题，以及其它不得代言的广告等四个方面列举了21项商业广告代言人资格及相关广告代言活动的负面清单。

Shanghai Releases Guidelines for Compliance of Advertising Endorsement

The Shanghai Municipal Administration for Market Regulation recently released the Guidelines for Compliance of Commercial Advertising Endorsement, setting the criterion in eight aspects for identification if someone has had the act of recommending or demonstrating a commercial good or service using his own name or image, as defined in the Advertising Law.
?
The Guidelines also laid out 21 qualifications for advertising endorsers, as well as a negative list of the relevant advertising endorsements, specifying the natural persons, legal persons and other organizations that are not allowed to endorse commercial advertising, the goods or services the advertising of which cannot be endorsed by advertising endorsers or select special entities, orientations prohibited from advertising endorsement, and other advertising of which endorsement is not allowed.???

2月10日，工信部发布《工业和信息化领域数据安全管理办法（试行）》，再次公开征求意见至2022年2月21日。

根据《管理办法》，工业和信息化领域数据处理者应当对数据处理活动负安全主体责任，对各类数据实行分级防护，不同级别数据同时被处理且难以分别采取保护措施的，应当按照其中级别最高的要求实施保护，确保数据持续处于有效保护和合法利用的状态。

The Ministry of Industry and Information Technology released On February 10, 2022 the Measures for Management of Data Security in Fields of Industry and Information Technology (for Trial Implementation) to solicit public opinions again until February 21, 2022.?

According to the Measures, data processors in the industry and IT fields should assume the main responsibility for the security of data processing to implement graded data protection. In the case of processing different grades of data at the same time and finding it difficult to take protective measures separately, they should implement the highest grade of protection to keep the data being effectively protected and legally used.

The National Development and Reform Commission and the National Energy Administration have jointly released the Opinions on Improving the Systems, Mechanisms and Policy Measures to Achieve Green and Low-carbon Energy Transition, noting that a complete policy framework would have been established for the development of green and low-carbon energy by 2030.?

It proposed to improve the systems designed for “double control” of energy consumption and use of non-fossil energy, strengthen top-level design and overall coordination, accelerate construction of national carbon emissions trading market, energy use trading market, and green power trading market, establish and improve mechanisms to promote green energy consumption, improve and promote trading of green power certificates, and spur consumption of green power.

It is specified that corporate attorneys should assist in the establishment of the corporate’s mechanism for response and disposal of criminal and law-breaking cases, conduct internal and external criminal risk assessment, strengthen criminal prevention education and training, improve the work system of reporting, reviewing and handling complaints and transferring clues, and cooperate with judicial organs and discipline inspection and supervision organs to handle case by law.????

八部门：落实税收优惠政策 ?推动工业资源综合利用

2月10日，工信部、发改委、财政部、税务总局等八部门联合发布《关于加快推动工业资源综合利用实施方案》，明确主要目标、重点任务、支持政策等内容。

政策支持方面，《方案》提出，开展“补贷保”联动试点，鼓励银行等金融机构按照市场化和商业可持续原则给予工业资源综合利用项目多元化信贷支持，支持符合条件的工业资源综合利用项目申请绿色信贷和发行绿色债券，创新金融产品和服务。充分发挥社会资本作用，鼓励社会资本出资设立工业资源综合利用产业发展基金。按规定落实资源综合利用增值税、企业所得税和环境保护税等优惠政策。
Authorities Vow to Promote Comprehensive Utilization of Industrial Resources with Preferential Tax Policies

Eight authorities led by the Ministry of Industry and Information Technology, the National Development and Reform Commission, the Ministry of Finance, and the State Taxation Administration jointly released on February 10, 2022 the Implementation Plan on Accelerating the Comprehensive Utilization of Industrial Resources, with the main goals, major tasks and supporting policies clarified.

The Plan proposed to adopt a pilot linkage mechanism of providing "subsidies, loans and insurance" to encourage banks and other financial institutions to diversify their credit supports to projects for comprehensive utilization industrial resources under the principles of marketization and commercial sustainability, and support qualified industrial resources utilization projects to apply for green credit and issue green bonds, and innovate financial products and services. It is also required to leverage the roles of social capital, encouraging establishment of industrial development funds for comprehensive utilization of industrial resources with social capital, and implement the preferential tax policies concerning the VAT for comprehensive utilization of resources, the enterprise income tax and the environmental protection tax according to rules.

《通知》明确，审计机关在审计过程中，有权依法向金融机构查询单位、个人账户和存款，并取得证明材料，金融机构应当予以协助。审计机关查询的账户和存款，包括单位、个人在政策性银行、商业银行、保险公司、信托投资公司、金融租赁公司、证券公司、证券投资基金管理公司、期货公司等金融机构开立的银行、证券、基金、信托、保险等各类账户。金融机构应当依法协助审计机关办理查询工作，如实提供相关资料，不得隐匿。

The National Audit Office and three other authorities released on February 10, 2022 the Circular on Issues concerning Audit Institutions’ Inquiries of Accounts and Deposits of Entities and Individuals at Financial Institutions.

It is clarified that audit institutions have the right to check the accounts and deposits of entities and individuals at financial institutions to get proof documentation when they conduct auditing, and the financial institutions should?provide assistance. The accounts and deposits that can be checked by audit institutions include various bank, securities, fund, trust and insurance accounts opened by entities and individuals at financial institutions such as policy banks, commercial banks, insurers, trust investment companies, financial leasing companies, securities companies, securities investment fund managers, and future companies, and those financial institutions should cooperate with the audit institutions for the checking by providing relevant documentation truthfully without concealment.

近日，国家广电总局印发《“十四五”中国电视剧发展规划》。

《规划》中提出，强化电视剧领域知识产权全链条保护，增强全行业尊重和保护知识产权的意识。

《规划》中还提出，坚决反对“天价片酬”，严格执行每部电视剧全部演员总片酬不得超过制作总成本40%，主要演员片酬不得超过演员总片酬 70%的制作成本配置比例规定，加强片酬合同备案与核查。行业组织制定标准化、规范化、制式统一的片酬合同示范文本，在电视剧行业推广使用。

NRTA Vows to Step up IP Protection in TV Series Sector
?
The National Radio and Television Administration recently released the 14th Five-Year Plan for the Development of China’s TV Series Sector.
?
In the Plan, the NRTA stressed the need to strengthen intellectual property protection along the entire chain of the TV series sector and to improve the awareness among all industry participants of respecting and protecting intellectual property.
?
Voicing its strong disapproval of "sky-high” for actors, the regulator also said total pay for actors in a TV series may not exceed 40% of total production cost, and capped the pay for key actors at 70% of total for all actors. Stricter recording and scrutiny of pay contracts will be implemented. Standardized pay contracts of uniform format shall be developed and widely adopted in the sector, the NRTA said.

Beijing Consults Public on Revised Draft Production Safety Rules

The Standing Committee of Beijing Municipal People’s Congress recently released the Regulations of Beijing Municipality on Production Safety (Revised Draft) for public comment until March 10, 2022.

In the Regulations, producers are expected to devote their production safety capital in the following production safety conduct:
(1) development of safety technology measures and engineering;
(2) upgrades and maintenance of safety equipment and facilities;
(3) production safety publicity, education and training;
(4) equipment of labor protective articles;
(5) monitoring of major dangerous sources;
(6) emergency rescue drills for production safety accidents;
(7) building of emergency rescue team or provision of rescue services; and

近日，北京市市场监管局发布《关于规范商业广告宣传的提醒告诫书》，提醒北京市广告活动参与者，坚持广告宣传正确的政治方向和价值导向，严禁借重大活动从事违法违规商业广告宣传活动。《告诫书》给出了16个方面的提醒，其中包括15个“严禁”和1个“鼓励”。

《告诫书》提出，“严禁”包括，严禁使用“特供”“专供”“给领导干部送礼”等广告宣传用语。严禁违法违规使用冬奥会、冬残奥会等奥林匹克标志以及亚运会等重大国际体育赛事特殊标志。严禁发布校外培训广告。严禁利用违法失德艺人作为广告代言人。

Beijing Prohibits Advertising Participants from Taking Occasion of Major Events to Release Illegal and Violating Commercial Advertising ?
?
The Beijing Municipal Administration for Market Regulation recently released the Letter of Warnings on Release of Commercial Advertisements, urging advertising participants in Beijing to keep to correct political and value orientations, and warning them not to conduct illegal or violating commercial advertising activities on occasion of major events. It made warnings on 16 behaviors, including 15 “strictly prohibited” behaviors, and one “encouraged” behavior.

The “strictly prohibited” behaviors include use of advertising words such as “special supply”, “exclusive supply”, “giving presents to leaders and cadres”, etc., use of Olympics logos such as Winter Olympics and Paralympics, use of special symbols for major international sports events such as Asian Games, release of advertising on off-campus tutoring, or asking law-breaking or immoral celebrities to act as advertising endorsers.

为了防范和应对外来入侵物种危害，保护生物多样性，2月11日，农业部发布《外来入侵物种管理办法（征求意见稿）》，公开征求意见至2022年3月11日。

《管理办法》提出，因品种培育等特殊需要从境外引进农作物和林草种子苗木、水产苗种等外来物种的，应当依据审批权限向省级以上人民政府农业农村、林业草原主管部门和海关办理进口审批与检疫审批。属于首次引进的，引进单位应当就引进物种对生态环境的潜在影响进行风险分析，并向审批部门提交风险评估报告。

According to the Measures, an organization who needs to import alien species such as crops, trees, grass, seeds, seedlings, and aquatic seedlings due to special needs should go through the procedures for import and quarantine examinations and approvals with the competent department of agriculture, rural affairs, forestry and grassland and the customs under the people's government at or above the provincial level. In the case of importing the species for the first time, the organization should conduct risk analysis on the potential impact of the import species on the ecological environment, and submit a risk assessment report to the examination and approval authorities.

The Standing Committee of Beijing Municipal People's Congress released on February 10, 2022 the Legislative Work Plan of the Standing Committee of Beijing Municipal People's Congress for the Year of 2022.?

In 2022, Beijing will deliberate 19 regulations, including the Regulation of Beijing Municipality on Protection of Intellectual Property Rights, and the Regulation of China (Beijing) Pilot Free Trade Zone; file and demonstrate three regulations, including the Regulation of Beijing Municipality for the Development of Green Buildings; and research and demonstrate 11 regulations, including the Regulation of Beijing Municipality on Management of Use Safety of Buildings, and the Regulation of Beijing Municipality on Promoting Development of Talents, according to the Plan.
