Fate of Shinde Fadnavis government to be decided on Thursday as the SC will announce verdict on Maharashtra power struggle

The Supreme Court judgement on Maharashtra power struggle is crucial as it will decide the fate of the Shinde Fadnavis government. It has been anxiously anticipated not just in the political circle but other sectors too.??The judgement will decide whether the Shinde Fadnavis government, which assumed the office on June 30, 2022, will continue or be replaced and it will also decided wither 16 MLAs will face disqualification. These mLAs included Eknath Shinde, Prakash Surve, Tanaji Sawant, Mahesh Shinde, Abdul Sattar, Sandipan Bhure, Bharat Gorawala, Sanjay Shirsat, Yamini Jadhav, Anil Babar, Lata Sonawane, Ramesh Bornare, Sanjay Railmulkar, Chimanrao Patil, Balaji Kalyankar and Balaji Kinikar.?

Minutes after the Chief Justice YV Chandrachud said that the Supreme Court Constitution Bench will deliver the judgement in Shiv Sena case (Maharashtra power struggle) on Thursday, the ruling and opposition have given their reactions.

Chief Minister Eknath Shinde’s son Shrikant Shinde, who is the MP from Kalyan seat in Thane district, expressed that the pending case in the apex court will be decided in favour of Shiv Sena led by his father.

Deputy Chief Minister Devendra Fadnavis said that Eknath Shinde will continue as the Chief Minister and the next election will be contested under his leadership.

Shiv Sena Uddhav Balasaheb Thackeray MP Sanjay Raut said, ‘’Is this country a democracy or not? Sanjay Raut said whether this country's legislative assembly and parliament are functioning according to the constitution or not, whether the Supreme Court, the judiciary is independent or under whose pressure it is working will be decided tomorrow.’’

‘’MLAs will be disqualified, government will come, government will go, these things happen in politics. But the future of this country will be decided tomorrow. In Pakistan today you see the constitution burning because a country like Pakistan is burning even if it is an enemy country. Because it did not work according to the constitution. Actions are being taken against opponents with vengeance. Governments are overthrown, governments are brought. Judiciary sold out, this picture should not exist in this country. For this, tomorrow's verdict of the Supreme Court is very important. Thousands of revolutionaries, freedom fighters have sacrificed for the freedom of this country. It also has the constitution given by Dr Babasaheb Ambedkar. The decision regarding their protection will come tomorrow, so we are hopeful",noted Raut.

Shiv Sena UBT legislator Aaditya Thackeray said, ‘’I have complete faith in the judiciary. Chief Minister is unethical and unconstitutional. We have waited for so many months, now wait for 24 hours and the whole picture will be clear.’’

State NCP chief spokesman Mahesh Tapase said that he expects that tomorrow’s judgement will further strengthen and protect the Constitution.

The power tussle started after the Deputy Speaker Narahari Jirwal issued notices to 16 MLAs aligned with Shinde, citing anti-defection and anti-party activities. The MLAs were??asked to respond in two days.

The 16 MLAs thereafter approached the Supreme Court and challenged the validity of the notices served by the Deputy Speaker. The Shinde group referring to past cases argued that action cannot be taken against the MLAs as no-confidence motions have been filed against the Deputy Speaker. However, Zirwal in his argument in the apex court??claimed that no confidence submitted against him did not originate from a registered email and therefore it was rejected forthwith.

During the hearing in the apex court, key questions were raised. They included whether MLAs violated anti defection act and included into anti party activities? Can Zirwal be disqualified if a no confidence motion is filed against him. Will Zirwal enjoy an authority to make decisions with regard to 16 MLAs especially after the election of Speaker (Rahul Narwekar) on July 3? How can the 16 MLAs against whom the disqualification notices were served vote during the Speaker’s election and how Speaker will have an authority to conduct the proceedings of those 16 MLAs for disqualification if it will be referred back to him by the apex court.
