My Client's "Guardianship Petition" (after clearing all the Probate Examiner's Notes) was granted by the Superior Court (for Appointment as Guardian of the Minor's "Estate" (real and personal property) left to him by his deceased Mother, the Decedent herein.)
Certified copies of the Letters of Guardianship were issued by the Court evidencing the Guardian's authority to act on behalf of the Minor's personal property interests (held by an insurance company) and real property interest (still in the name of the Decedent with an underlying mortgage).
Guardian (natural Father of the Minor and Unmarried partner of Minor's Mother for 15 years) was ordered as a matter of routine for Guardianship of "the Estate"--to post a minimum $20,000 Bond and return Proof to the Court.
Guardian was further ordered to deposit the personal funds of Minor into what's called a blocked account (at a bank with branch address identified Pre-hearing) and return Proof to the Court.
Guardian was furthered ordered to provide the Bank with a "Receipt and Acknowledgment"to be executed acknowledging receipt of the funds from Guardian and deposit by the Bank. The Bank returns Proof to the Court that's also provided in the form.
Guardian's "Certified Letters of Guardianship" will be given to the mortgage holder who will transfer the mortgage to Client's name and out of the name of the Decedent so Guardian can pay the remainder of the mortgage and protect the Minor's real property interests.
The Guardian will attend a Compliance hearing (that will be vacated) should he return all Proofs to the court (within the prescribed time) that the Minor's personal and real property interests are protected.
The real property will be transferred into the Guardian's name , by ex parte hearing, pursuant to the CA Uniform Transfers to Minors Act, and out of the name of the Decedent for the duration of the Minor's incapacity until his age of majority, at which time of the age of majority, the real property will be transferred into the Minor's name.
