The Evolving Landscape of PFAS Regulation and Litigation in Food Packaging

Transparency: More Than a Demand, A Necessity

Per- and polyfluorinated substances (PFAS) have long been utilized in various consumer and industrial products for their unique properties, such as heat resistance and nonstick qualities. However, mounting evidence has linked these chemicals to significant health and environmental concerns, including cancer and soil contamination. Notably, PFAS have found their way into food packaging, raising alarms about potential health risks associated with their presence.

At 3E, we recognize the importance of staying abreast of the evolving regulatory and legal landscape surrounding PFAS in food packaging. Our expertise allows us to assist companies in identifying the presence of PFAS in their packaging materials and exploring viable alternatives.

The regulatory oversight of PFAS in food packaging primarily falls under the jurisdiction of the Food and Drug Administration (FDA) and the Environmental Protection Agency (EPA) in the United States. While the FDA has set limits for certain PFAS, comprehensive regulations are still lacking. However, recent actions by the EPA, including the restriction of certain long-chain PFAS, signal a growing awareness of the need for stricter oversight.

Additionally, several states have taken proactive measures to regulate PFAS in food packaging, with bans and disclosure requirements becoming increasingly common. These state-level regulations underscore the urgency of addressing PFAS contamination and highlight the need for companies to reassess their practices.

Amidst this regulatory scrutiny, consumer class action lawsuits targeting PFAS in food packaging have proliferated. These legal actions underscore the imperative for companies to prioritize consumer safety and transparency in their product offerings.

At 3E, we stand ready to assist companies in navigating the complex regulatory landscape surrounding PFAS in food packaging. Our comprehensive solutions enable companies to identify PFAS presence, evaluate regulatory compliance, and explore alternative materials to mitigate risks.

In conclusion, the increasing regulatory oversight and litigation surrounding PFAS in food packaging underscore the urgent need for proactive measures. By partnering with 3E, companies can proactively address regulatory constraints, minimize legal risks, and uphold their commitment to consumer safety and environmental stewardship. Let us guide you in navigating this evolving landscape and ensuring the integrity of your packaging materials.

We've only seen the beginning of addressing the tradeoffs organizations need to make when addressing PFAS. On one hand, PFAS can prevent infections and contamination. On the other, the continuous use of PFAS containing materials may not be worth all of the risks involved. Nothing is cut and dry and this article brings to light the need to address complexities in organizations and complex supply chains.
